About this statute

This Act may be cited as the Controller of Budget ("the Controller of Budget appointed under Article 228 of the Constitution;") Act. Section sets out definitions for terms used in the Act, including "accounting officer", "any other public funds", "Cabinet Secretary", "Controller of Budget", "public officer", "Public Service Commission" and "State organ". The Cabinet Secretary must report to Parliament on funds withheld, explaining why the withholding should be continued or withdrawn. Delegate in writing any of his or her powers to any employee in the Office of the Controller of Budget; or instruct in writing any employee in the Office of the Controller of Budget to perform any of the duties of his or her office; such delegation shall be subject to any conditions the Controller of Budget may impose and shall not divest the Controller of Budget of the responsibility concerning the exercise of the power or the performance of the duty. The Controller of Budget may appoint necessary staff and, when doing so, must be guided by Articles 27 and 232 of the Constitution.
