PUBLISHING DETAILS Page 2 SL 14 of 2026 c Caymanian Protection (Fees) Regulations, 2026 Regulation 1 CAYMAN ISLANDS Caymanian Protection Act (2022 Revision) CAYMANIAN PROTECTION (FEES) REGULATIONS, 2026 (SL 14 of 2026) In exercise of the powers conferred by 72 of the Caymanian Protection Act (2022 Revision), the Cabinet makes the following Regulations — 1. Citation and commencement 1. (1) These Regulations may be cited as the Caymanian Protection (Fees) Regulations, 2026. (2) These Regulations come into force immediately after the Immigration (Transition) (Amendment and Validation) Act, 2026 comes into force. 2. Prescribed fees 2. The prescribed fees for the purposes of the Act are specified in the Schedule and where a fee is indicated to be an annual fee, it shall be payable annually. 3. Fees: refund, waiver, reduction and exemption 3. (1) The Cabinet may refund, waive or reduce any or all of the fees in the Schedule in relation to a person or group of persons. (2) Where a permanent resident is granted the right to be Caymanian within three, six or nine months of having paid the relevant annual fee in respect of permanent residence, that person is entitled to a refund of the annual fee as follows— c SL 14 of 2026 Page 3 Regulation 3 Caymanian Protection (Fees) Regulations, 2026 (a) if the fee was paid less than three months before the grant, to seventy-five per cent of the fee paid; (b) if the fee was paid between three months and less than six months before the grant, to fifty per cent of the fee paid; and (c) if the fee was paid between six months and up to nine months before the grant, to twenty-five per cent of the fee paid, within three months after the receipt of the request for refund. (3) The employer of a person working by operation of law shall be refunded fifty per cent of the fee paid where that person ceases to so work within six months of the commencement of the period in respect of which the fee was paid. (4) In accordance with section 67(2)(b) of the Act, no fee shall be charged in respect of — (a) the application for a work permit or the grant of a work permit authorising the gainful occupation of the classes of persons set out at Item 24 in the Schedule; and (b) repatriation of the classes of persons set out at Item 24 in the Schedule. $10,400 (c) where annual work permit fee is more than 5,000 $10,400 3.2 Issue fee for Residency and Employment Rights Fee varies based on Certificate for persons who have been legally and annual earnings ordinarily resident in the Islands for a minimum period of eight years: Where holder earns — 500 (a) $20,000 per annum or less (b) between $20,001 and $40,000 per annum 1,250 (c) between $40,001 and $60,000 per annum 2,500 (d) between $60,001 and $80,000 per annum 3,750 (e) between $80,001 and $100,000 per annum 5,000 (f) between $100,001 and $150,000 per annum 9,000 (g) $150,000 and above per annum 12,500 3.3 Issue fee where a dependant has been included in the 400 per dependant original application for, or has subsequently been added to, a Residency and Employment Rights Certificate 3.4 Annual fee where the dependant has been included in the original application for or has subsequently been added on variation to, the grant or renewal of a permanent residence — (a) where annual work permit fee for the holder 350 per dependant is $2,100 or less (b) where annual work permit fee for the holder 525 per dependant is between $2,101 - $10,400 (c) where annual work permit fee for the holder 750 per dependant is more than $10,400 Application for the variation of a Residency and 3.5 500 Employment Rights Certificate c SL 14 of 2026 Page 7 SCHEDULE Caymanian Protection (Fees) Regulations, 2026 ITEM PROVISION SUBJECT MATTER FEE (CI$) 3.6 Other than the persons listed in 3.8 (a) to (f) below, all Fee varies (see Schedule persons holding a Residency and Employment Rights of Annual Work Permit Certificate, (whether or not engaging in gainful Fees) occupation in Grand Cayman, Cayman Brac and Little Cayman) or their respective employers are required to pay an annual fee on or before the anniversary date of the issue of the Certificate equivalent to the annual fee payable by a work permit holder in the same occupation 3.7 Filing fee associated with the filing of annual 250 declarations by the holder 3.8 The following persons are exempt from the requirement to pay the annual fee in respect of a Residency and Employment Rights Certificate: (a) Spouse or civil partner of a Caymanian nil (b) Surviving spouse or civil partner of a nil Caymanian who has not re-married or re- entered a civil partnership with a non- Caymanian (c) Contracted Government employees nil (d) A person who is granted asylum under nil section 111(4) of the Customs and Border Control Act (2024 Revision) (e) Employees of the Cayman Islands Monetary nil Authority (f) Persons working for a non-profit nil organisation as defined in section 2 of the Non-Profit Organisations Act (2020 Revision) (g) Employees of the Health Services Authority nil (h) Employees of the University College of the nil Cayman Islands Note 1: Where more than one occupation is authorised in the Certificate, the fee payable shall be equivalent to the occupation which attracts the higher fee. Note 2: Where a Certificate is varied to change occupation and the new occupation attracts a higher annual fee, the fee payable until the following anniversary date shall be the difference between that applicable to the former occupation and that of the new occupation. Thereafter, the fee payable shall be the fee for the new occupation Note 3: In the event that an application for permanent residence is refused, all fees submitted with the application other than the application fee shall be refunded to the applicant. PERSONS EXEMPT FROM WORK PERMIT FEES 24 67 24.1 In addition to children and young persons under the age of eighteen, the following persons are exempt from any requirement to pay work permit fees: (a) Spouse or civil partner of a Caymanian (b) Surviving spouse or civil partner of a Caymanian who has not re-married or re-entered a civil partnership with a non-Caymanian (c) Employees of the Government on contract (d) A person who is declared by the Cabinet to be exempt in accordance with section 53(1)(b) (e) Cayman Islands Monetary Authority employees (f) Persons working for a non-profit organisation as defined in section 2 of the Non-Profit Organisations Act (2020 Revision) (g) Employees of the Health Services Authority (h) Employees of the University College of the Cayman Islands 24.2 The following persons are exempt from the requirement to pay non-refundable repatriation fees or work permit dependant fees: (a) Employees of the Government on contract including teachers who are licensed by the Cayman Islands Education Council (b) Ministers of Religion (c) Cayman Islands Monetary Authority employees (d) Employees of the Health Services Authority (e) Employees of the University College of the Cayman Islands Note: 1. Where a work permit is granted or renewed for six months or less, fifty percent of the relevant annual fee is payable. Where a work permit ceases to be effective for any reason and the employee has worked for six months or less, a refund of no more than one half of the annual fee is to be made. If the employee has worked for more than six months no refund will be made. Where a temporary work permit has been issued for less than ninety days, there will be no fee payable for extending it up to ninety days. Where an extension beyond ninety days is sought (i.e. for a further period of up to ninety days), one half of the annual fee is payable regardless of the length of the extension. 4. Where a work permit is granted or renewed for the holder to have more than one occupation, the fee payable shall be equivalent to the occupation which attracts the higher fee. 5. All refund requests for Certificate for Specialist Caregivers are subject to the same conditions as specified in section 67 of the Caymanian Protection Act (2022 Revision). 6. Where the term “fee varies” is indicated, refer to Part 2 – Schedule of Annual Work Permit Fees in order to determine the accurate fee. 7. The developer of the special economic zone known as Cayman Enterprise City or a special economic zone enterprise carrying on special economic zone business in the special economic zone known as Cayman Enterprise City shall in respect of an employee — (a) be exempt from the payment of the annual work permit fees specified in Part 2 including application fees, fees for variation of a work permit and fees in respect of dependants of the employee; and (b) pay an annual work permit fee of $1,230.00. 2. Where an employee of the developer of the special economic zone known as Cayman Enterprise City or a special economic zone enterprise carrying on special economic zone business in the special economic zone known as Cayman Enterprise City is granted permanent residence, the annual fee shall be based on the annual work permit fee for the respective occupation specified in Part 2 instead of the annual work permit fee set out in paragraph 1(b).
