About this statute

This preamble identifies the decree and states that it concerns closing industrial or commercial businesses belonging to people who collaborated with the enemy, where continued operation would threaten public order. Workshops, shops, and industrial or commercial enterprises owned by persons who collaborated with the enemy during the occupation may be closed if continuing them would threaten public order. This article assigns certain matters to the cantonal court at the place where the business is located, requires assessors to swear an oath before taking office, and lets the Minister of Justice set the assessors’ indemnities. Le tribunal cantonal peut ordonner la fermeture provisoire ou définitive de l’entreprise. Une fermeture provisoire ne peut pas dépasser six mois. If closure is ordered under the previous article, the court sets the closure terms and may order sale, transfer, continued operation, sequestration, or other necessary measures.
