Statute overview

About this statute

This is the preamble of the law, stating that the Grand Duke orders the law after consultation and assent. In sales or exchanges of domestic animals, warranty claims are governed by the following rules unless the parties agreed otherwise. Certain animal diseases or defects are treated as redhibitory vices and can, in sales or exchanges, give rise only to the action referred to in Article 1641 of the Civil Code. The action must be brought within a deadline set by the same method, starting on the delivery date and capped at 30 days; if the last day is a holiday, it moves to the next day. The buyer must ask for experts to be appointed within the Article 3 time limit, state the alleged defect in the request, and submit it to the justice of the peace. If the animal was taken abroad, the buyer must also bring it back within the allowed time plus three days and use the correct local justice of the peace; contagious defects and death abroad bar the action.
