Statute overview

About this statute

This provision identifies a law creating a creditor committee to protect creditors’ interests in bankruptcies and concordats. After a bankruptcy declaration, the judge-commissioner must appoint a three-member creditors’ committee within 15 days, unless the commercial court orders that no committee is needed. The juge commissaire must arrange for the creditors’ committee to be set up within eight days, after six months from the bankruptcy judgment, if no closure or concordat-approval judgment has intervened by then. Les créanciers doivent exercer personnellement les fonctions de membre du comité des créanciers; un créancier personne morale peut toutefois se faire représenter par son mandataire légal prévu par son acte constitutif. The creditors’ committee assists the curator, supervises the bankruptcy process, and is consultative.
