About this statute

This law amends the 12 June 1874 mining law by repealing articles 7, 9, 10 and 11 and replacing them with new provisions. Les exploitants miniers ont le droit d’occuper les terrains nécessaires à leur exploitation et d’y réaliser les travaux miniers, moyennant l’indemnité annuelle prévue. The mining operator must pay yearly compensation, get prior approval before occupying land, and restore the land when it is no longer needed. If occupation has split a land parcel so the remaining parts can no longer be suitably used, the annual compensation also applies to those remaining parts. The owner may also extend a request for acquisition or compensation for damage to those remaining parts if the owner uses the rights in article 9(4) or 9(5). If the owner and the mining operator do not agree on the price of land to be transferred, the district court decides the price. If the operator does not start the judicial price-fixing procedure within three months after formal notice, the owner may apply to court without further formality to seek transfer of the land and a price decision.
