About this statute
This preamble states that Luxembourg approves the Benelux Convention on the uniform law relating to penalties for non-compliance (astreinte). This article approves the Benelux Convention signed in The Hague on 26 November 1973 to introduce a uniform law on astreinte. The French text of the uniform law will have the force of internal law in Luxembourg when the convention enters into force there, as fixed by a grand-ducal regulation. From the law’s entry into force, this article adds a sixteenth title to Book III of the Civil Code: “Title XVI. - De l’astreinte.” The judge may, on a party’s request, order the other party to pay an astreinte if the main judgment is not satisfied; this is not allowed when the judgment is for payment of money.
