Statute overview
About this statute
This provision is the preamble to a law on creating a leave of absence for private-sector employees. This article grants adoption leave in private-sector employment, mainly to an employed woman adopting a child, and in some cases to her spouse or a single adoptant. For an adopted child not yet in the first year of primary school, the allowance is paid for eight weeks after the adoption judgment is entered in the civil status registers, if it was not already granted under article 5 and the adopters meet the domicile conditions. Private-sector employees are granted two days of leave when welcoming a child under 16 for adoption, unless they already receive the foster-care leave provided by the law of 14 March 1988. Violations of this law are punishable by imprisonment, a fine, or both.
