About this statute

A foreigner planning to leave the Grand Duchy for more than 6 months must file a departure declaration with the competent authority of the commune where they stayed. Un étranger ne peut pas rester dans le pays au-delà de la période fixée par règlement grand-ducal sans autorisation de séjour, sous réserve d’exceptions prévues par le droit communautaire et les engagements internationaux. A foreigner’s identity card may be refused, and a residence authorization valid for up to 12 months may be refused or revoked. If entry, residence authorisation, an უცხer identity card, or renewal of that card is refused or withdrawn, the foreigner must leave Luxembourg within the deadline set, starting from notification of the decision. The Minister of Justice takes certain decisions, but public-health-driven decisions require a proposal from the Minister of Health. Ministerial decisions must be notified administratively and copies given to the interested persons.
