Le procureur d'Etat peut décider de recourir à une médiation avant de statuer sur l'action publique, si cela peut réparer le dommage, mettre fin au trouble ou aider au reclassement de l'auteur. Le médiateur est tenu au secret professionnel. A grand-ducal regulation sets the criteria and procedure for approval as a mediator, the mediation procedure, and how mediators are paid. This article amends the judicial organisation law by adding magistrates who carried out a mediation to article 64-1 and by inserting “service de médiation” after “service d’aide aux victimes” in article 77. This article replaces article 90-9 of the social security code and refers to volunteer activity for approved social services and volunteer mediation.
