This is the preamble and formal enactment wording of the law. This article defines several terms used in the law, including competent ministers, undertakings in difficulty, SMEs, large enterprises, the Commission, credit institutions, credit, guarantees, and de minimis aid. Les ministres compétents peuvent accorder une garantie de l’État avant le 31 décembre 2010 pour certains crédits aux entreprises visées à l’article 3. The law applies to certain Luxembourg businesses with an establishment authorisation and to listed liberal professions, but excludes businesses in difficulty before 1 July 2008 and businesses supervised by the CSSF or the Commissariat aux assurances. Article 4 sets the procedure for applying for a State guarantee: the company and the credit institution file a written joint application, with supporting documents, and the company must promptly report any aid received during the process.
