Henri Doc. parl. 7369 ; sess. ord. 2017-2018 et 2018-2019. â Convention de sécurité sociale entre le Gouvernement du Grand-Duché de Luxembourg et le Gouvernement de la République de Corée, faite à Luxembourg, le 1 er mars 2018 Le Gouvernement du Grand-Duché de Luxembourg et le Gouvernement de la République de Corée (ci-après dénommés les Parties contractantes), Animés du désir de régler les rapports réciproques entre leurs deux pays dans le domaine de la sécurité sociale, Ont convenu de ce qui suit : Partie I Dispositions générales Article 1 er Définitions 1. Aux fins de la présente convention le terme: (a) âRessortissantâ désigne (i) en ce qui concerne le Grand-Duché de Luxembourg (ci-après dénommé « Luxembourg »), un ressortissant du Luxembourg, et (ii) en ce qui concerne la République de Corée (ci-après dénommée « Corée »), un ressortissant de Corée comme il est défini sous la « Nationalty Law »; (b) « Législation » désigne les lois et règlements visés à lâarticle 2 de la présente convention ; (c) « Autorité compétente » désigne les ministères compétents pour lâapplication de la législation visée à lâarticle 2 de la présente convention ; (d) « Institution compétente » désigne (i) en ce qui concerne le Luxembourg, lâinstitution, lâorganisme ou lâautorité responsable pour lâapplication de lâensemble ou dâune partie de la législation visée au paragraphe 1 point b) de lâarticle 2, et (ii) en ce qui concerne la Corée, le Service National des Pensions; (e) « période dâassurance » désigne toute période de cotisation prise en compte et accomplie sous la législation dâune Partie contractante, ainsi que toute autre période reconnue comme équivalente à une période de cotisation sous cette législation; (f) « prestation » désigne toute pension ou prestation en espèces, y compris tous les suppléments ou majorations, prévus par la législation visée à lâarticle 2 de la présente convention. 2. Tout autre terme qui nâest pas défini dans cet article a la signification qui lui est donnée par la législation applicable. Article 2 Législations couvertes 1. Cette convention sâapplique aux législations suivantes: (a) en ce qui concerne le Luxembourg, (i) lâassurance pension en cas de vieillesse, dâinvalidité et de survie, (ii) les articles 2 et 173 du Code de la sécurité sociale pour lâapplication de lâarticle 8, et (iii) en ce qui concerne la Partie II uniquement, lâassurance maladie-maternité, lâassurance accidents du travail et maladies professionnelles, les prestations de chômage et les prestations familiales. (b) en ce qui concerne la Corée, (i) la Loi Nationale des Pensions, et (ii) en ce qui concerne la Partie II uniquement, la Loi sur lâAssurance Emploi, la Loi sur lâAssurance Nationale de Santé et la Loi sur lâAssurance dâIndemnisation des Accidents du Travail. 2. A moins quâil ne soit disposé autrement dans la présente convention, les législations visées au paragraphe 1 de cet article nâincluent pas les traités ou autres conventions internationales de sécurité sociale éventuellement conclus entre une Partie contractante et un Etat tiers, ou la législation adoptée spécifiquement pour leur application. 3. La présente convention sâapplique également à toute législation future qui modifie, complète, codifie ou remplace les législations visées au paragraphe 1 du présent article. 4. Nonobstant le paragraphe 3 du présent article, la présente convention ne sâapplique pas aux lois et règlements portant extension de la législation existante dâune Partie contractante à de nouvelles catégories de bénéficiaires, si lâautorité compétente de cette Partie contractante notifie par écrit à lâautorité compétente de lâautre Partie contractante, dans les six mois de la date dâentrée en vigueur de tels lois ou règlements, quâune telle extension nâest pas voulue. 5. La présente convention ne sâapplique ni à lâassistance sociale, ni aux prestations en faveur des victimes de la guerre. Article 3 Champ dâapplication personnel La présente convention sâapplique à toute personne qui est ou a été soumise à la législation dâune Partie contractante, ainsi quâaux ayants droits et survivants dâune telle personne au sens de la législation applicable de cette Partie contractante. Article 4 Ãgalité de traitement A moins quâil ne soit disposé autrement dans la présente convention, toute personne visée à lâarticle 3, qui réside sur le territoire dâune Partie contractante, a droit, selon lâapplication de la législation de cette Partie contractante, à lâégalité de traitement avec les ressortissants de cette Partie contractante. Cette disposition sâapplique aussi aux ayants droits et survivants qui résident sur le territoire de lâune des Partie contractantes en ce qui concerne les droits qui sont dérivés des personnes visées dans cet article. Article 5 Exportation des prestations 1. Les prestations acquises au titre de la législation dâune Partie contractante ne peuvent subir aucune réduction, modification, suspension, suppression ou confiscation du fait que le bénéficiaire réside ou séjourne sur le territoire de lâautre Partie contractante et les prestations sont payées sur le territoire de lâautre Partie contractante. 2. Les prestations acquises au titre de la législation dâune Partie contractante sont accordées aux bénéficiaires de lâautre Partie contractante qui résident en dehors du territoire des Parties contractantes dans les mêmes conditions quâelles sont accordées aux ressortissants de la première Partie contractante qui résident en dehors des territoires des Parties contractantes. Article 6 Clauses de réduction ou de suspension Les clauses de réduction ou de suspension prévues par la législation dâune Partie contractante, en cas de cumul dâune prestation avec dâautres prestations de sécurité sociale ou avec des revenus professionnels, sont opposables au bénéficiaire, même sâil sâagit de prestations acquises en vertu dâun régime de lâautre Partie contractante ou si lâactivité professionnelle est exercée sur le territoire de lâautre Partie contractante. Article 7 Prolongation de la période de référence Si la législation dâune Partie contractante subordonne lâouverture du droit aux prestations à lâaccomplissement dâune période dâassurance minimale au cours dâune période déterminée précédant la survenance du fait assuré (période de référence) et si cette législation dispose que certains faits ou circonstances prolongent cette période, ces faits et circonstances produisent le même effet lorsquâils surviennent sur le territoire de lâautre Partie contractante. Article 8 Admission à lâassurance volontaire continuée 1. Les dispositions de la législation dâune Partie contractante qui subordonne lâadmission à lâassurance volontaire continuée à la résidence sur le territoire de cette Partie contractante ne sâappliquent pas aux personnes qui résident sur le territoire de lâautre Partie contractante, à condition quâelles aient été soumises, à un moment quelconque de leur carrière passée, à la législation de la première Partie contractante en qualité de travailleur. 2. Si la législation dâune Partie contractante subordonne lâadmission à lâassurance volontaire continuée à lâaccomplissement de périodes dâassurance, les périodes dâassurance accomplies sous la législation de lâautre Partie contractante sont prises en compte, dans la mesure nécessaire, comme sâil sâagissait de périodes dâassurance accomplies sous la législation de la première Partie contractante. Partie II Dispositions concernant lâassujettissement Article 9 Dispositions générales Sous réserve des exceptions prévues dans la présente Partie, une personne qui exerce une activité salariée ou non salariée sur le territoire de lâune des Parties contractantes est, par rapport à cette activité, soumise à la législation de cette Partie contractante. Article 10 Travailleurs détachés 1. Si une personne au service dâun employeur ayant son siège sur le territoire dâune Partie contractante est envoyée par cet employeur sur le territoire de lâautre Partie contractante pour y effectuer un travail pour le compte de cet employeur, seule la législation sur lâassurance obligatoire de la première Partie contractante continue à sâappliquer en ce qui concerne ce travail pendant les soixante premiers mois de calendrier, comme si le salarié était toujours occupé sur le territoire de la première Partie contractante. Ce paragraphe sâapplique aussi à un salarié qui a été envoyé par son employeur établi sur le territoire dâune Partie contractante auprès dâune succursale ou société affiliée sur le territoire de lâautre Partie contractante. 2. Lorsque le détachement continue au-delà de la période prévue au paragraphe 1 du présent article, la législation de la première Partie contractante mentionnée dans ledit paragraphe, continue à sâappliquer, à condition que les autorités compétentes des deux Parties contractantes ou les institutions compétentes désignées par elles se mettent dâaccord, sur demande conjointe du salarié et de lâemployeur. Article 11 Travailleurs non salariés 1. Un travailleur non salarié qui réside habituellement sur le territoire dâune Partie contractante et qui travaille sur le territoire de lâautre Partie contractante ou sur le territoire des deux Parties contractantes est soumis, en ce qui concerne ce travail, à la législation de la première Partie contractante pendant les soixante premiers mois de calendrier. 2. Une personne exerçant une activité salariée sur le territoire des deux Parties contractantes ou qui exerce une activité non salariée sur le territoire dâune Partie contractante et une activité salariée sur le territoire de lâautre Partie contractante, est soumise exclusivement à la législation de la Partie contractante sur le territoire de laquelle elle réside habituellement, pendant les soixante premiers mois de calendrier. 3. Lorsque lâactivité non salariée continue au-delà de la période prévue aux paragraphes 1 et 2 du présent article, la législation de la première Partie contractante mentionnée dans ces paragraphes continue à sâappliquer, à condition que les autorités compétentes des deux Parties contractantes ou les institutions compétentes désignées par celles-ci se mettent dâaccord, sur demande du travailleur non salarié. Article 12 Gens de mer et équipages dâavions 1. Une personne qui, en vertu de la présente convention, serait soumise à la législation des deux Parties contractantes en ce qui concerne son occupation en tant quâofficier ou membre dâéquipage dâun navire est soumise à la seule législation de la Partie Contractante sur le territoire de laquelle elle réside habituellement. 2. Une personne qui est employée en tant quâofficier ou membre de lâéquipage dâun avion reste, en ce qui concerne cet emploi, soumise à la législation de la Partie contractante sur le territoire de laquelle lâentreprise qui lâoccupe a son siège. Toutefois, si lâentreprise possède une succursale ou une représentation permanente sur le territoire de lâautre Partie contractante, une telle personne qui est employée par cette succursale ou représentation permanente et qui nâest pas visée par lâarticle 10, est soumise à la législation de la Partie contractante sur le territoire de laquelle la succursale ou représentation permanente se situe. Article 13 Membres des missions diplomatiques et postes consulaires, et fonctionnaires 1. Les dispositions de la présente convention ne portent pas atteinte aux dispositions de la convention de Vienne sur les relations diplomatiques du 18 avril 1961 ou de la convention de Vienne sur les relations consulaires du 24 avril 1963. 2. Sous réserve du paragraphe 1 du présent article, une personne employée par un service gouvernemental central ou local ou tout autre service public dâune Partie contractante, qui est détachée sur le territoire de lâautre Partie contractante reste soumise à la législation de la première Partie contractante comme si elle était employée sur le territoire de celle-ci. Article 14 Exceptions aux articles 9 à 13 Les autorités compétentes des deux Parties contractantes, ou les institutions compétentes désignées par celles-ci, peuvent convenir dâaccorder une exception aux articles 9 à 13 pour certaines personnes ou catégories de personnes, à condition que chaque personne concernée soit soumise à la législation de lâune des Parties contractantes. Partie III Dispositions concernant les prestations Section I - Dispositions communes concernant les prestations Article 15 Totalisation des périodes dâassurance 1. Lorsque des périodes dâassurance ont été accomplies sous la législation des deux Parties contractantes, lâinstitution compétente de chaque Partie contractante prend en compte, pour la détermination du droit aux prestations selon la législation quâelle applique, les périodes dâassurance accomplies sous la législation de lâautre Partie contractante, si nécessaire et dans la mesure où ces périodes dâassurance ne coïncident pas avec des périodes dâassurance accomplies sous sa législation. 2. Si la législation dâune Partie contractante soumet lâoctroi de certaines prestations à la condition que les périodes dâassurance soient accomplies dans une occupation spécifique, seules les périodes dâassurance accomplies dans la même occupation sous la législation de lâautre Partie contractante, ou reconnues comme équivalentes, sont totalisées pour lâadmission au bénéfice de ces prestations. 3. Si une personne nâa pas droit à une prestation sur la base des périodes dâassurance accomplies sous les législations des deux Parties contractantes, totalisées comme prévu aux paragraphes 1 et 2 du présent article, le droit à ladite prestation est à déterminer en totalisant ces périodes avec les périodes dâassurance accomplies sous la législation dâun Etat tiers avec lequel les deux Parties contractantes sont liées par des instruments de sécurité sociale qui prévoient la totalisation de périodes dâassurance, à condition que ces périodes dâassurance ne coïncident pas avec des périodes dâassurance accomplies sous la législation des deux Parties contractantes. Article 16 Calcul des pensions A moins quâil ne soit disposé autrement dans la présente convention, le calcul de la pension est régi par la législation applicable de la Partie contractante respective. Section II - Dispositions particulières relatives au Luxembourg Article 17 Calcul des prestations 1. Si une personne peut prétendre à une prestation en vertu de la législation luxembourgeoise sans faire application de lâarticle 15 de la présente convention, lâinstitution compétente luxembourgeoise calcule, selon les dispositions de la législation quâelle applique, la prestation correspondant à la durée totale des périodes dâassurance à prendre en compte en vertu de cette législation. 2. Lâinstitution compétente procède aussi au calcul du montant de la prestation qui serait due en application des dispositions du paragraphe 3 du présent article. Seul le montant le plus élevé de ces deux montants est pris en considération. 3. Si une personne ne peut prétendre à une prestation que par la prise en compte de périodes totalisées conformément à lâarticle 15 de la présente convention, les règles suivantes sâappliquent: (a) lâinstitution compétente calcule le montant théorique de la prestation due, comme si toutes les périodes dâassurance accomplies en vertu des législations des deux Parties contractantes avaient été accomplies exclusivement sous la législation luxembourgeoise ; (b) pour la détermination du montant théorique visé au sous-paragraphe (a), la base de calcul est à établir exclusivement sur la base des périodes dâassurance accomplies sous la législation luxembourgeoise ; (c) sur la base du montant visé au sous-paragraphe (a), lâinstitution compétente calcule ensuite le montant effectivement dû, au prorata de la durée des périodes dâassurance accomplies sous la législation luxembourgeoise par rapport à la durée totale des périodes dâassurance accomplies en vertu des législations des deux Parties contractantes. 4. Lorsque les conditions requises pour lâouverture du droit à prestation sont remplies uniquement après application du paragraphe 3 de lâarticle 15, les périodes dâassurance accomplies sous la législation de lâEtat tiers visé dans ce paragraphe sont prises en considération pour lâapplication du paragraphe 3 du présent article. Article 18 Disposition particulière de la législation luxembourgeoise (années bébés) Lors du calcul dâune pension, les dispositions de lâarticle 15 de la présente convention sâappliquent pour la reconnaissance des années bébés prévues par la législation luxembourgeoise, à condition que la personne concernée ait accompli en dernier lieu des périodes dâassurance sous la législation luxembourgeoise avant la naissance ou lâadoption de lâenfant. Section III - Dispositions particulières relatives à la Corée Article 19 Prestations sous la législation coréenne 1. Lorsque des périodes dâassurance en vertu de la législation luxembourgeoise sont prises en considération en vue dâétablir le droit aux prestations sous la législation coréenne conformément au paragraphe 1 de lâarticle 15, la prestation due est déterminée comme suit: (a) lâinstitution compétente coréenne calcule dâabord un montant de pension égal au montant qui serait dû à la personne si toutes les périodes dâassurance prises en compte sous la législation des deux Parties contractantes avaient été accomplies sous la législation coréenne. En vue de déterminer le montant de la pension, lâinstitution compétente coréenne prend en considération le revenu mensuel ordinaire moyen perçu par la personne pendant son assujettissement à la législation coréenne ; (b) lâinstitution compétente coréenne calcule la prestation partielle à verser conformément à la législation coréenne sur la base du montant de pension calculé conformément au sous-paragraphe précédent, au prorata de la durée des périodes dâassurance prises en considération selon sa propre législation par rapport à la durée totale des périodes dâassurance prises en considération en vertu des législations des deux Parties contractantes. 2. Les remboursements forfaitaires sont accordés aux ressortissants de lâautre Partie contractante dans les mêmes conditions quâils sont accordés aux ressortissants coréens. Nonobstant les articles 4 et 5 de la présente convention, les remboursements forfaitaires sont versés aux ressortissants dâun Etat tiers conformément à la législation coréenne. 3. Lorsque les conditions requises pour lâouverture du droit à prestation sont remplies seulement après lâapplication du paragraphe 3 de lâarticle 15, les périodes dâassurance accomplies sous la législation de lâEtat tiers visé dans ce paragraphe sont prises en considération pour lâapplication du paragraphe 1 du présent article. Partie IV Dispositions diverses Article 20 Arrangement administratif 1. Les autorités compétentes des Parties contractantes concluent un arrangement administratif fixant les modalités nécessaires pour lâapplication de la présente convention. 2. Les organismes de liaison de chaque Partie contractante sont désignés dans lâarrangement administratif. Article 21 Ãchange dâinformations et assistance réciproque 1. Les autorités et institutions compétentes des Parties contractantes, dans le cadre de leurs compétences respectives : (a) se communiquent réciproquement, dans la mesure où la législation quâelles appliquent le permet, toutes informations nécessaires pour lâapplication de la présente convention ; (b) sâentraident en ce qui concerne la détermination du droit à , ou le paiement de, toute prestation en vertu de la présente convention ou de la législation à laquelle sâapplique la présente convention ; et (c) se communiquent dès que possible les informations concernant les mesures prises par elles pour lâapplication de la présente convention, ainsi que tout changement susceptible dâaffecter lâapplication de la présente convention. 2. Lâentraide dont il est fait référence au sous-paragraphe 1(b) du présent article est fournie sans frais, sous réserve dâéventuelles exceptions convenues dans lâarrangement administratif conclu conformément au paragraphe 1 de lâarticle 20. Article 22 Confidentialité des informations A moins quâil ne soit exigé autrement par les lois et règlements nationaux dâune Partie contractante, les informations concernant une personne, communiquées conformément à la présente convention à lâautorité ou lâinstitution compétente de cette Partie contractante par lâautorité ou lâinstitution compétente de lâautre Partie contractante, sont utilisées exclusivement en vue de lâapplication de la présente convention et de la législation à laquelle sâapplique la présente convention. De telles informations reçues par lâautorité ou lâinstitution compétente dâune Partie contractante sont régies par les lois et règlements nationaux de cette Partie contractante concernant la protection de la vie privée et la confidentialité des données personnelles. Article 23 Exemption de taxes et de lâobligation de légalisation 1. Lorsque la législation dâune Partie contractante prévoit que tout document soumis à lâautorité ou lâinstitution compétente de cette Partie contractante est dispensé entièrement ou partiellement de taxes ou de frais, y inclus les frais consulaires et administratifs, cette dispense sâapplique aussi aux documents correspondants soumis à lâautorité ou lâinstitution compétente de lâautre Partie contractante dans lâapplication de la présente convention ou de la législation de lâautre Partie contractante. 2. Les documents et les certificats produits par lâautorité ou lâinstitution compétente de chacune des Parties contractantes pour lâapplication de la présente convention ou de la législation de lâautre Partie contractante, sont dispensés du visa de légalisation des autorités diplomatiques ou consulaires ou de toute autre formalité similaire. 3. Les copies de documents certifiées conformes par lâautorité ou lâinstitution compétente de lâune des Parties contractantes sont acceptées comme des copies conformes et exactes par lâautorité ou lâinstitution compétente de lâautre Partie contractante, sans légalisation supplémentaire. Article 24 Langue de communication 1. Les autorités et institutions compétentes des Parties contractantes peuvent communiquer directement entre elles, ainsi quâavec toute personne concernée, quel que soit son lieu de résidence, chaque fois que câest nécessaire pour lâapplication de la présente convention ou des législations auxquelles sâapplique la présente convention. La correspondance peut être effectuée dans une des langues officielles des Parties contractantes ou en langue anglaise. 2. Une demande ou un document ne peut pas être rejeté par une autorité ou institution compétente dâune Partie contractante, uniquement parce quâil est rédigé dans la langue officielle de lâautre Partie contractante. Article 25 Introduction de demandes, déclarations ou recours 1. Chaque demande, déclaration ou recours concernant la détermination ou le paiement dâune prestation en vertu de la législation dâune Partie contractante qui aurait dû être introduit, selon cette législation, dans un délai déterminé auprès de lâautorité ou institution compétente de cette Partie contractante, mais qui est présenté dans le même délai auprès de lâautorité ou institution compétente de lâautre Partie contractante, est considéré comme étant introduit dans les délais auprès de lâautorité ou institution compétente de la première Partie contractante. 2. Si, après lâentrée en vigueur de la présente convention, une personne introduit une demande écrite pour lâoctroi de prestations auprès de lâinstitution compétente dâune Partie contractante en vertu de la législation de cette Partie contractante, et si cette personne nâa pas demandé explicitement que la demande soit limitée aux prestations de cette législation, la demande couvre également les droits de cette personne à des prestations correspondantes sous la législation de lâautre Partie contractante, à condition quâau moment de la demande, cette personne : (a) ait le droit, en raison de son âge, de déposer une demande valide pour une prestation de lâautre Partie contractante ; et (b) demande que celle-ci soit considérée comme une demande sous la législation de lâautre Partie contractante ; ou (c) fournisse des informations indiquant que des périodes dâassurance ont été accomplies sous la législation de lâautre Partie contractante. Toutefois, cette disposition ne sâapplique pas si le requérant demande explicitement que sa demande se limite aux prestations sous la législation de la première Partie contractante. 3. Dans tous les cas où sâapplique le paragraphe 1 ou 2 du présent article, lâautorité ou institution compétente à laquelle la demande, la déclaration ou le recours a été soumis, indique la date de réception du document et le transmet sans délai à lâautorité ou institution compétente de lâautre Partie contractante. Article 26 Paiement des prestations 1. Lâinstitution compétente dâune Partie contractante peut verser des prestations conformément à la présente convention dans la monnaie de cette Partie contractante. 2. Au cas où une Partie contractante impose des mesures de contrôle monétaire ou dâautres mesures similaires limitant les versements, remises ou transferts de fonds ou dâinstruments financiers à des personnes qui se trouvent en dehors du territoire de cette Partie contractante, elle prend sans délai les mesures appropriées en vue dâassurer le paiement de toute somme qui est due conformément à la présente convention aux personnes visées à lâarticle 3. Article 27 Règlements de différends Tout différend concernant lâapplication de la présente convention est réglé par consultation entre autorités compétentes. Partie V Dispositions transitoires et finales Article 28 Dispositions transitoires 1. Toute période dâassurance accomplie sous la législation de lâune des Parties contractantes avant la date dâentrée en vigueur de la présente convention et tout autre évènement pertinent qui sâest produit avant cette date, est pris en considération pour la détermination du droit à une prestation conformément à la présente convention. Toutefois, aucune institution compétente des deux Parties contractantes nâest tenue de prendre en compte des périodes dâassurance accomplies antérieurement à la date à partir de laquelle des périodes dâassurance peuvent être créditées en vertu de sa législation. 2. La présente convention nâouvre aucun droit au paiement de prestations pour une période antérieure à la date de son entrée en vigueur. 3. Les déterminations de droits à prestation effectuées avant lâentrée en vigueur de la présente convention nâont pas dâeffet sur les droits sâouvrant aux termes de la convention. 4. Les prestations déterminées avant lâentrée en vigueur de la présente convention peuvent être révisées sur demande si un changement de ces prestations résulte des seules dispositions de la présente convention. Si la révision prévue à la phrase précédente de ce paragraphe résulte dans la suppression du droit ou dans un montant de pension inférieur à celui payé en dernier lieu avant lâentrée en vigueur de la présente convention, le même montant de pension que celui payé antérieurement continue à être versé. 5. Pour lâapplication de lâarticle 10 dans le cas de personnes envoyées dans une Partie contractante avant la date dâentrée en vigueur de la présente convention, les périodes dâoccupation auxquelles il est fait référence dans cet article sont considérées comme débutant à cette date. 6. Les dispositions de la Partie III sâappliquent seulement aux prestations pour lesquelles une demande a été déposée à la date de lâentrée en vigueur de la présente convention ou après cette date. Article 29 Entrée en vigueur La présente convention entre en vigueur le premier jour du troisième mois qui suit le mois au cours duquel chaque Partie contractante a reçu de lâautre Partie contractante la notification écrite quâelle a accompli toutes les formalités requises pour lâentrée en vigueur de la présente convention. Article 30 Durée et dénonciation 1. La présente convention reste en vigueur et applicable jusquâau dernier jour du douzième mois suivant le mois au cours duquel une Partie contractante a notifié sa dénonciation par écrit à lâautre Partie contractante. 2. En cas de dénonciation de la présente convention les droits à prestations et leur paiement acquis en vertu de celle-ci sont maintenus. Pour le Gouvernement du Grand-Duché de Luxembourg Romain Schneider Ministre de la Sécurité sociale Pour le Gouvernement de la République de Corée Kim Hyoung-zhin Ambassadeur de la République de Corée auprès du Grand-Duché de Luxembourg â Agreement on social security between the Government of the Grand Duchy of Luxembourg and the Government of the Republic of Korea, done at Luxembourg, on 1 st of March 2018. The Government of the Grand Duchy of Luxembourg and the Government of the Republic of Korea (hereinafter referred to as the âContracting Partiesâ), Being desirous of regulating the relationship between their two countries in the field of social security, Have agreed as follows: Part I General Provisions Article 1 Definitions 1. For the purpose of this Agreement: (a) âNationalâ means: (i) as regards the Grand Duchy of Luxembourg (hereinafter referred to as âLuxembourgâ), a national of Luxembourg, and (ii) as regards the Republic of Korea (hereinafter referred to as âKoreaâ), a national of Korea as defined in the Nationality Law; (b) âLegislationâ means the laws and regulations specified in Article 2 of this Agreement; (c) âCompetent Authorityâ means the Ministries in charge of enforcing the legislation mentioned in Article 2 of this Agreement; (d) âCompetent Institutionâ means: (i) as regards Luxembourg, the institution, body or authority responsible for applying all or part of the legislation specified in paragraph 1(a) of Article 2, and (ii) as regards Korea, the National Pension Service; (e) âPeriod of coverageâ means any period of contributions that has been recognized and completed under the legislation of a Contracting Party, and any other period recognized as equivalent to a period of contribution under that legislation; (f) âBenefitâ means any pension or benefit in cash, including any supplements or increases, provided for in the legislation specified in Article 2 of this Agreement. 2. Any term not defined in this Article shall have the meaning assigned to it in the applicable legislation. Article 2 Applicable Legislation 1. This Agreement shall apply to the following legislation: (a) as regards Luxembourg, (i) pension insurance in case of old-age, invalidity and survivorship, (ii) Articles 2 and 173 of the Social Security Code for the purpose of Article 8, and (iii) with regard to Part II only, sickness and maternity insurance, accidents at work and occupational diseases insurance, unemployment benefits and family benefits. (b) as regards Korea, (i) the National Pension Act, and (ii) with regard to Part II only, the Employment Insurance Act, the National Health Insurance Act and the Industrial Accident Compensation Insurance Act. 2. Unless otherwise provided in this Agreement, the legislation referred to in paragraph 1 of this Article shall not include treaties or other international agreements on social security that may be concluded between one Contracting Party and a third State, or legislation promulgated for their specific implementation. 3. This Agreement shall also apply to future legislation which amends, supplements, consolidates or supersedes the legislation specified in paragraph 1 of this Article. 4. Notwithstanding paragraph 3 of this Article, this Agreement shall not apply to the laws or regulations which extend existing legislation of one Contracting Party to new categories of beneficiaries, if the Competent Authority of that Contracting Party notifies the Competent Authority of the other Contracting Party in writing, within six months from the date of the entry into force of such laws or regulations, that no such extension to the Agreement is intended. 5. This Agreement shall neither apply to social assistance, nor to benefits for victims of war. Article 3 Personal Scope This Agreement shall apply to any person who is or who has been subject to the legislation of either Contracting Party, and to the dependents and survivors of such a person within the meaning of the applicable legislation of either Contracting Party. Article 4 Equal Treatment Unless otherwise provided in this Agreement, any person described in Article 3 who resides in the territory of either Contracting Party, shall, in the application of the legislation of the Contracting Party, receive equal treatment with nationals of that Contracting Party. The foregoing shall also apply to the dependents and survivors who reside in the territory of either Contracting Party with respect to their rights derived from the persons specified in this Article. Article 5 Export of Benefits 1. Benefits under the legislation of one Contracting Party shall not be subject to any reduction, modification, suspension, withdrawal or confiscation by reason of the fact that the recipient resides or stays in the territory of the other Contracting Party, and the benefits shall be payable in the territory of the other Contracting Party. 2. Benefits under the legislation of one Contracting Party shall be granted to the beneficiaries of the other Contracting Party who reside outside the territories of the Contracting Parties under the same conditions as they are granted to the nationals of the first Contracting Party who reside outside the territories of the Contracting Parties. Article 6 Reduction or Suspension Clauses The reduction or suspension clauses provided for in the legislation of one Contracting Party, in case one benefit coincides with other social security benefits or with other professional income, shall be applied to the beneficiaries, even if these benefits were acquired by virtue of a scheme of the other Contracting Party, or if the related professional activities are exercised in the territory of the other Contracting Party. Article 7 Extension of the Reference Period If the legislation of one Contracting Party makes the entitlement to benefits conditional upon the completion of a minimum insurance period during a specified period preceding the insured contingency (reference period), and if that legislation stipulates that certain facts or circumstances shall extend this reference period, those facts and circumstances have the same effect when they occur in the territory of the other Contracting Party. Article 8 Admission to Optional Continued Insurance 1. The provisions of the legislation of a Contracting Party which make the admission to optional continued insurance conditional upon residence in the territory of that Contracting Party shall not apply to persons residing in the territory of the other Contracting Party, provided that at some time in their past working life they were as a worker subject to the legislation of the first Contracting Party. 2. Where, under the legislation of a Contracting Party, admission to optional continued insurance is conditional upon completion of insurance periods, the insurance periods completed under the legislation of the other Contracting Party shall be taken into account, to the extent necessary, as if they were completed under the legislation of the first Contracting Party. Part II Provisions on Coverage Article 9 General Provisions Except as otherwise provided in this Part, an employed or self-employed person who works in the territory of one Contracting Party shall, with respect to that work, be subject only to the legislation of that Contracting Party. Article 10 Detached Workers 1. Where a person in the service of an employer having a registered office in the territory of one Contracting Party is sent by that employer to work on that employer's behalf in the territory of the other Contracting Party, only the legislation on compulsory coverage of the first Contracting Party shall continue to apply with regard to that employment during the first sixty calendar months as though the employee were still employed in the territory of the first Contracting Party. This paragraph shall also apply to an employee who has been sent by his or her employer in the territory of one Contracting Party to the employer's affiliated or subsidiary company in the territory of the other Contracting Party. 2. In case the detachment continues beyond the period specified in paragraph 1 of this Article, the legislation of the first Contracting Party referred to in that paragraph shall continue to apply, provided that the Competent Authorities of both Contracting Parties or the Competent Institutions designated by them consent upon the joint request of the employee and the employer. Article 11 Self-Employed Persons 1. A self-employed person who ordinarily resides in the territory of a Contracting Party and who works in the territory of the other Contracting Party or in the territories of both Contracting Parties shall, in respect of that work, be subject only to the legislation of the first Contracting Party during the first sixty calendar months. 2. A person who is employed in the territories of both Contracting Parties or self-employed in the territory of a Contracting Party and employed in the territory of the other Contracting Party shall be subject only to the legislation of the Contracting Party in whose territory he or she ordinarily resides during the first sixty calendar months. 3. In case the self-employed activity continues beyond the period specified in paragraphs 1 and 2 of this Article, the legislation of the first Contracting Party referred to in those paragraphs shall continue to apply, provided that the Competent Authorities of both Contracting Parties or the Competent Institutions designated by them consent upon the request of the self-employed person. Article 12 Mariners and Aircraft Crew 1. A person who, but for this Agreement, would be subject to the legislation of both Contracting Parties with respect to employment as an officer or member of a crew on a ship shall be subject only to the legislation of the Contracting Party in the territory of which the person ordinarily resides. 2. A person who is employed as an officer or member of the crew of an aircraft shall, in respect of that employment, be subject to the legislation of the Contracting Party in the territory of which the enterprise by which he or she is employed has its head office. If, however, the enterprise has a branch or permanent presence in the territory of the other Contracting Party, such a person employed by that branch or permanent presence and who is not subject to Article 10 shall be subject to the legislation of the Contracting Party in the territory of which the branch or permanent presence is located. Article 13 Members of Diplomatic Missions and Consular Posts, and Civil Servants 1. Nothing in this Agreement shall affect the provisions of the Vienna Convention on Diplomatic Relations of April 18, 1961, or of the Vienna Convention on Consular Relations of April 24, 1963. 2. Subject to paragraph 1 of this Article, a person employed by the central or local government service, or any other public service of a Contracting Party, who is sent to work in the territory of the other Contracting Party, shall be subject to the legislation of the first Contracting Party as if he or she were employed in its territory. Article 14 Exceptions to Articles 9 to 13 The Competent Authorities of the two Contracting Parties or the Competent Institutions designated by them may agree to grant an exception to Articles 9 to 13 with respect to particular persons or categories of persons, provided that any affected person shall be subject to the legislation of one Contracting Party. Part III Provisions on Benefits Section I - Common Provisions on Benefits Article 15 Totalization of Periods of Coverage 1. When periods of coverage have been completed under the legislation of the two Contracting Parties, the Competent Institution of each Contracting Party shall, in determining eligibility for benefits under the legislation which it applies, take into account, if necessary, periods of coverage under the legislation of the other Contracting Party, provided that such periods of coverage do not overlap with periods of coverage under its legislation. 2. If the legislation of one Contracting Party subordinates the granting of certain benefits to the condition that the periods of coverage are to be completed in a given occupation, only periods of coverage completed or recognized as equivalent in the same occupation under the legislation of the other Contracting Party shall be totalized for admission to entitlement to these benefits. 3. If a person is not entitled to a benefit on basis of the periods of coverage completed under the legislation of both Contracting Parties, totalized according to paragraphs 1 and 2 of this Article, the right to the said benefit is to be determined by totalizing those periods with the periods of coverage completed under the legislation of a third State, with whom both Contracting Parties are bound by social security instruments which provide for the totalization of periods of coverage, provided that such periods of coverage do not overlap with periods of coverage under the legislation of both Contracting Parties. Article 16 Calculation of Pensions The calculation of the pension shall be determined by the applicable legislation of the respective Contracting Party unless otherwise provided in this Agreement. Section II - Special Provisions relating to Luxembourg Article 17 Calculation of Benefits 1. If a person is entitled to a benefit under the legislation of Luxembourg without applying Article 15 of this Agreement, the Competent Institution of Luxembourg shall calculate, according to the legislation it applies, the benefit on the basis of the total periods of coverage to be taken account of by virtue of that legislation. 2. The Competent Institution shall also calculate the amount of the benefit that would be obtained by applying the rules specified in paragraph 3 of this Article. Only the higher of these two amounts shall be taken into consideration. 3. If a person is entitled to a benefit only by taking into account periods of coverage totalized pursuant to Article 15 of this Agreement, the following rules shall apply: (a) the Competent Institution shall calculate the theoretical amount of the benefit due as if all the periods of coverage completed under the legislation of both Contracting Parties were exclusively completed under the legislation of Luxembourg; (b) for determining the theoretical amount referred to under sub-paragraph (a), the calculation basis is to be established by reference only to those periods of coverage completed under the legislation of Luxembourg; (c) the Competent Institution shall then calculate the amount due, on the basis of the amount specified under sub-paragraph (a), in proportion to the periods of coverage completed under the legislation of Luxembourg, in relation to the total periods of coverage completed under the legislation of both Contracting Parties. 4. Where the conditions required for the entitlement to a benefit are satisfied only after the application of paragraph 3 of Article 15, the periods of coverage completed under the legislation of the third State referred to in that paragraph shall be considered for the application of paragraph 3 of this Article. Article 18 Particular Provision of Luxembourg Legislation (baby-years) When calculating a pension, the provisions of Article 15 of this Agreement shall apply for the acknowledgement of the baby-years provided for under the legislation of Luxembourg, under the condition that the person concerned last completed periods of coverage under the legislation of Luxembourg before the birth or adoption of the child. Section III - Special Provisions relating to Korea Article 19 Benefits under the Legislation of Korea 1. Where periods of coverage under the legislation of Luxembourg are taken into account to establish eligibility for benefits under the legislation of Korea in accordance with paragraph 1 of Article 15, the benefits due shall be determined as follows: (a) the Competent Institution of Korea shall first compute a pension amount equal to the amount that would have been payable to the person if all the periods of coverage taken into account under the legislation of the two Contracting Parties had been completed under the legislation of Korea. To determine the pension amount, the Competent Institution of Korea shall take into account the person's average standard monthly income while covered under the legislation of Korea; (b) the Competent Institution of Korea shall calculate the partial benefit to be paid in accordance with the legislation of Korea based on the pension amount calculated according to the preceding sub-paragraph, in proportion to the ratio between the duration of the periods of coverage taken into consideration under its own legislation and the total duration of the periods of coverage taken into consideration under the legislation of the two Contracting Parties. 2. Lump-sum refunds shall be granted to nationals of the other Contracting Party under the same conditions as they are granted to Korean nationals. Notwithstanding Articles 4 and 5 of this Agreement, lump-sum refunds shall be paid to nationals of a third State only in accordance with the legislation of Korea. 3. Where the conditions required for the entitlement to a benefit are satisfied only after application of paragraph 3 of Article 15, the periods of coverage completed under the legislation of the third State referred to in that paragraph shall be considered for the application of paragraph 1 of this Article. Part IV Miscellaneous Provisions Article 20 Administrative Arrangement 1. The Competent Authorities of the Contracting Parties shall conclude an Administrative Arrangement that sets out the measures necessary for the implementation of this Agreement. 2. The liaison agencies of each Contracting Party shall be designated in the Administrative Arrangement. Article 21 Exchange of Information and Mutual Assistance 1. The Competent Authorities and Institutions of the Contracting Parties shall, within the scope of their respective competence: (a) communicate to each other, to the extent permitted by the legislation which they administer, any information necessary for the application of this Agreement; (b) assist each other with regard to the determination of entitlement to, or payment of, any benefit under this Agreement, or the legislation to which this Agreement applies; and (c) communicate to each other, as soon as possible, the information concerning the measures taken by them for the application of this Agreement and any changes in their respective legislation which may affect the application of this Agreement. 2. The assistance referred to in sub-paragraph 1(b) of this Article shall be provided free of charge, subject to any exceptions to be agreed upon in the Administrative Arrangement concluded pursuant to paragraph 1 of Article 20. Article 22 Confidentiality of Information Unless otherwise required by the national laws and regulations of a Contracting Party, information about an individual which is transmitted in accordance with this Agreement to the Competent Authority or Institution of that Contracting Party by the Competent Authority or Institution of the other Contracting Party shall be used exclusively for the purposes of implementing this Agreement and the legislation to which this Agreement applies. Such information received by a Competent Authority or Institution of a Contracting Party shall be governed by the national laws and regulations of that Contracting Party for the protection of the privacy and confidentiality of personal data. Article 23 Exemption from Fees and Certification of Documents 1. Where the legislation of a Contracting Party provides that any document which is submitted to the Competent Authority or Institution of that Contracting Party shall be exempted, wholly or partly, from fees or charges, including consular and administrative fees, the exemption shall also apply to corresponding documents which are submitted to the Competent Authority or Institution of the other Contracting Party in the application of this Agreement or of the legislation of the other Contracting Party. 2. Documents and certificates which are presented by the Competent Authority or Institution of either Contracting Party for the application of this Agreement or of the legislation of the other Contracting Party shall be exempted from the requirements for authentication by diplomatic or consular authorities or any other similar formalities. 3. Copies of documents which are certified as true and exact copies by the Competent Authority or Institution of one Contracting Party shall be accepted as true and exact copies by the Competent Authority or Institution of the other Contracting Party, without further certification. Article 24 Language of Communication 1. The Competent Authorities and Institutions of the Contracting Parties may correspond directly with one another as well as with any person, wherever that person may reside, whenever it is necessary to do so for the application of this Agreement or of the legislation to which this Agreement applies. The correspondence may be made in any official language of either Contracting Party or in the English language. 2. An application or document may not be rejected by a Competent Authority or Institution of a Contracting Party solely because it is in an official language of the other Contracting Party. Article 25 Submission of Claims, Notices or Appeals 1. Any claim, notice or appeal concerning the determination or payment of a benefit under the legislation of a Contracting Party which should, for the purposes of that legislation, have been filed within a prescribed period with the Competent Authority or Institution of that Contracting Party, but which is instead filed within the same period to the Competent Authority or Institution of the other Contracting Party, shall be considered to have been filed on time with the Competent Authority or Institution of the first Contracting Party. 2. If, after the entry into force of this Agreement, a person files a written application for benefits with the Competent Institution of a Contracting Party under the legislation of that Contracting Party, and if that person has not explicitly requested that the application be restricted to benefits under that legislation, the application shall also protect the rights of that person to corresponding benefits under the legislation of the other Contracting Party, provided that the person at the time of application: (a) is entitled on age grounds to lodge a valid claim for a benefit of the other Contracting Party; and (b) requests that it be considered as an application under the legislation of the other Contracting Party; or (c) provides information indicating that periods of coverage have been completed under the legislation of the other Contracting Party. However, the foregoing shall not apply if the applicant explicitly requests that the application be restricted to benefits under the legislation of the first Contracting Party. 3. In any case to which paragraph 1 or 2 of this Article applies, the Competent Authority or Institution to which the claim, notice or appeal has been submitted shall indicate the date of receipt of the document and forward it without delay to the Competent Authority or Institution of the other Contracting Party. Article 26 Payment of Benefits 1. The Competent Institution of a Contracting Party may pay benefits in accordance with this Agreement in the currency of that Contracting Party. 2. In the event that a Contracting Party imposes currency controls or other similar measures that restrict payments, remittances or transfers of funds or financial instruments to persons who are outside the territory of that Contracting Party, it shall, without delay, take appropriate measures to ensure the payment of any amount that must be paid in accordance with this Agreement to persons described in Article 3. Article 27 Resolution of Disagreements Any disagreement regarding the application of this Agreement shall be resolved by consultation between the Competent Authorities. Part V Transitional and Final Provisions Article 28 Transitional Provisions 1. Any period of coverage completed before the date of entry into force of this Agreement, and any other relevant events that occurred before that date, shall be taken into consideration in determining the right to a benefit under this Agreement. However, the Competent Institution of neither Contracting Party shall be required to take into account periods of coverage which occurred prior to the earliest date for which periods of coverage may be credited under its legislation. 2. This Agreement shall not establish any right to receive payment of a benefit for any period before the date of the entry into force of this Agreement. 3. Determinations concerning entitlement to benefits which were made before the entry into force of this Agreement shall not affect rights arising under it. 4. Benefits determined before the entry into force of this Agreement may be newly determined upon application if a change in such benefits results solely from the provisions of this Agreement. If the new determination under the preceding sentence of this paragraph results in no entitlement or entitlement to a lesser amount of pension than paid for the last period prior to the entry into force of this Agreement, the same amount of pension as previously paid shall continue to be paid. 5. In applying Article 10 in case of persons who were sent to a Contracting Party prior to the date of entry into force of this Agreement, the periods of employment referred to in that Article shall be considered to begin on the date of entry into force of this Agreement. 6. The provisions of Part III shall apply only to benefits for which an application is filed on or after the date this Agreement enters into force. Article 29 Entry into Force This Agreement shall enter into force on the first day of the third month following the month in which each Contracting Party has received from the other Contracting Party written notification that it has complied with all requirements for the entry into force of this Agreement. Article 30 Period of Duration and Termination 1. This Agreement shall remain in force and effect until the last day of the twelfth month following the month in which written notice of its termination is given by either Contracting Party to the other Contracting Party. 2. If this Agreement is terminated, rights regarding entitlement to or payment of benefits acquired under it shall be retained. The Contracting Parties shall make arrangements dealing with rights in the process of being acquired. IN WITNESS WHEREOF, the undersigned, being duly authorized thereto, have signed this Agreement. DONE in duplicate at Luxembourg, on 1 st of March 2018, in the French, Korean and English languages, each text being equally authentic.
