Henri Doc. parl. 7602 ; sess. ord. 2019-2020 et 2020-2021. â ACCORD ENTRE LE GOUVERNEMENT DU GRAND-DUCHà DE LUXEMBOURG ET LE GOUVERNEMENT DE LA RÃPUBLIQUE DE SERBIE CONCERNANT LâÃCHANGE ET LA PROTECTION RÃCIPROQUE DâINFORMATIONS CLASSIFIÃE Le Gouvernement du Grand-Duché de Luxembourg et Le Gouvernement de la République de Serbie (ci-après : « les Parties »), Reconnaissant la nécessité dâétablir des règles sur la protection dâinformations classifiées échangées dans le cadre de la coopération relative aux aspects politiques, militaires, sécuritaires, économiques, juridiques, scientifiques et technologiques ou toute autre sorte de coopération, ainsi que dâinformations classifiées produites au cours du processus dâune telle coopération, Entendant assurer la protection réciproque de toutes les informations classifiées, qui ont été classifiées par lâune des Parties et transférées à lâautre Partie ou conjointement produites au cours de la coopération entre les Parties, Désirant établir un ensemble de règles régissant la protection réciproque dâinformations classifiées, produites ou échangées entre les Parties, Compte tenu des intérêts communs dans la protection dâinformations classifiées, conformément aux lois et règlementations nationales des Parties, Conviennent ce qui suit : Article 1 Objet et champ d'application 1. Le présent Accord a pour but de garantir la protection des informations classifiées conjointement produites ou échangées entre les Parties. 2. Le présent Accord est applicable à lâensemble des activités, contrats ou accords impliquant des informations classifiées qui seront menés ou conclus entre les Parties à lâavenir. Article 2 Définitions Aux fins du présent Accord : a) « Infraction à la sécurité » désigne tout acte ou omission contraire au présent Accord ou à la législation nationale des Parties, susceptible dâentraîner la divulgation, la perte, la destruction, le détournement ou tout autre type de compromission dâinformations classifiées ; b) « Contrat classifié » désigne un accord entre deux contractants ou sous-traitants, ou plus, lequel contient des informations classifiées ou lâapplication duquel nécessite lâaccès aux informations classifiées ; c) les « informations classifiées » désignent toute information, quelle quâen soit la forme, transmise ou produite entre les Parties conformément aux lois et réglementations nationales de chacune des Parties, nécessitant une protection contre toute divulgation non autorisée, tout détournement ou toute perte, désignée en conséquence ; d) « Autorité compétente » désigne lâautorité nationale de sécurité ou toute autre autorité compétente qui, conformément aux lois et réglementations nationales, est chargée de superviser la mise en Åuvre du présent Accord, telle que définie au paragraphe 1 de lâarticle 4 des présentes ; e) « Contractant » désigne toute personne physique ou morale dotée de la capacité juridique de conclure des contrats classifiés ; f) « Habilitation de sécurité dâétablissement » désigne toute décision de lâautorité compétente selon laquelle le contractant ou le sous-traitant satisfait aux exigences matérielles et organisationnelles requises pour traiter et stocker des informations classifiées jusquâà un certain niveau de classification de sécurité, conformément aux lois et réglementations nationales ; g) « Besoin dâen connaître » fait référence à la nécessité dâaccéder à des informations classifiées spécifiques dans le cadre de fonctions officielles déterminées et/ou en vue de lâaccomplissement dâune mission spécifique ; h) « Partie dâorigine » désigne la Partie, en ce compris toute instance qui fournit des informations classifiées conformément aux lois et réglementations nationales ; i) « Habilitation de sécurité individuelle » désigne toute décision de lâautorité compétente selon laquelle le ressortissant concerné est autorisé à accéder à des informations classifiées jusquâà un certain niveau de classification de sécurité, conformément aux lois et réglementations nationales ; j) « Partie destinataire » désigne la Partie, en ce compris toute instance à laquelle la Partie dâorigine transmet des informations classifiées ; k) « Sous-traitant » désigne tout contractant avec lequel le premier contractant conclut un contrat de sous-traitance ; l) « Tierce partie » désigne tout Ãtat, organisation, entité juridique ou personne physique, qui nâest pas lâune des Parties au présent Accord ; Article 3 Niveaux de classification de sécurité Les Parties reconnaissent que les niveaux et marquages de classification de sécurité suivants sont équivalents et correspondent aux niveaux de classification de sécurité spécifiés dans leur législation nationale : Pour la République de Serbie Pour le Grand-Duché de Luxembourg Ãquivalent en anglais ÐÐ ÐÐÐÐРТÐÐÐÐ TRÃS SECRET LUX TOP SECRET СТРÐÐÐ ÐÐÐÐÐ ÐÐÐÐ SECRET LUX SECRET ÐÐÐÐÐ ÐÐÐÐ CONFIDENTIEL LUX CONFIDENTIAL ÐÐТÐÐ ÐÐ RESTREINT LUX RESTRICTED Article 4 Autorités compétentes 1. Les autorités compétentes des Parties sont : Pour le Gouvernement de la République de Serbie : KанÑелаÑиÑа СавеÑа за наÑÐ¸Ð¾Ð½Ð°Ð»Ð½Ñ Ð±ÐµÐ·Ð±ÐµÐ´Ð½Ð¾ÑÑ Ð¸ заÑÑиÑÑ ÑаÑÐ½Ð¸Ñ Ð¿Ð¾Ð´Ð°Ñака (Bureau du Conseil national de sécurité et protection des informations classifiées) Pour le Gouvernement du Grand-Duché de Luxembourg : Service de renseignement de lâÃtat Autorité nationale de sécurité 2. Les Parties se tiennent mutuellement informées, par la voie diplomatique, de tout changement et de toute modification concernant leurs autorités compétentes. 3. Les autorités compétentes se tiennent mutuellement informées des lois et réglementations en vigueur dans leur Ãtat, ainsi que de toute modification qui leur est apportée et affecte la protection des informations classifiées produites ou échangées conformément au présent Accord. 4. En vue dâappliquer et de maintenir des normes de sécurité similaires, les autorités compétentes se tiennent mutuellement informées de toute norme, procédure et pratique de sécurité appliquées par chaque Partie en matière de protection des informations classifiées. Article 5 Mesures applicables à lâaccès aux informations classifiées et à leur protection 1. Conformément aux dispositions de leurs lois et réglementations nationales, les Parties prennent toutes les mesures appropriées afin de protéger les informations classifiées échangées ou produites en vertu du présent Accord. Elles garantissent auxdites informations classifiées un niveau de protection équivalent à celui qui est accordé à leurs informations classifiées nationales assorties du niveau de classification de sécurité correspondant, conformément à lâarticle 3 du présent Accord. 2. La Partie dâorigine informe par écrit la Partie destinataire de toute modification apportée au niveau de classification de sécurité des informations classifiées transmises afin de mettre en Åuvre les mesures de protection appropriées. 3. Lâaccès aux informations classifiées est exclusivement réservé aux personnes autorisées, en vertu des lois et réglementations nationales, à accéder à des informations classifiées dâun niveau de classification de sécurité équivalent, qui ont besoin de connaître de telles informations et ont été informées en conséquence. 4. Dans le cadre du présent Accord, chacune des Parties reconnaît le caractère équivalent des habilitations de sécurité individuelles et dâétablissement établies par lâautre Partie conformément aux lois et règlementations nationales. 5. Sur demande et conformément aux lois et règlementations nationales, les autorités compétentes se prêtent mutuellement assistance dans le cadre de la mise en Åuvre des procédures dâhabilitation requises en vertu du présent Accord. 6. Dans le cadre du présent Accord, les autorités compétentes des Parties se tiennent mutuellement informées sans délai de toute modification apportée aux habilitations de sécurité individuelles et dâétablissement, en particulier de tout déclassement ou déclassification. 7. Sur demande de lâautorité compétente de la Partie dâorigine, lâautorité compétente de la Partie destinataire confirme par écrit quâune personne sâest vue octroyer une habilitation de sécurité individuelle ou quâune entité juridique sâest vue octroyer une habilitation de sécurité dâétablissement. 8. La Partie destinataire : a) ne divulgue aucune information classifiée à une quelconque tierce partie sans lâaccord écrit de la Partie dâorigine délivré conformément aux lois et réglementations nationales ; b) classifie les informations reçues conformément au niveau de sécurité équivalent mentionné à lâarticle 3 ; c) ne déclassifie aucune des informations classifiées fournies et sâinterdit de leur octroyer un niveau de protection inférieur sans lâaccord écrit de la Partie dâorigine ; d) nâutilise les informations classifiées quâaux fins prévues. Article 6 Transmission des informations classifiées 1. Les informations classifiées sont transmises par des voies diplomatiques ou militaires, à moins que les autorités compétentes nâapprouvent un autre moyen de transmission, conformément aux lois et réglementations nationales. La Partie destinataire confirme par écrit la réception des informations classifiées. 2. La transmission électronique dâinformations classifiées est effectuée par le biais de méthodes cryptographiques approuvées par les autorités compétentes, conformément aux lois et réglementations nationales. 3. Les services de renseignement, de sécurité et de police des Parties peuvent, conformément aux lois et réglementations nationales, échanger directement entre eux des informations opérationnelles et/ou des renseignements. Article 7 Reproduction et traduction d'informations classifiées 1. La traduction et la reproduction dâinformations classifiées se font conformément aux lois et règlementations nationales de la Partie destinataire et aux procédures suivantes : a) les traductions et les reproductions sont classifiées et protégées de la même manière que les informations classifiées originales ; b) les traductions et le nombre de copies sont limités à ceux requis pour un usage officiel ; c) les traductions sont accompagnées dâune note appropriée dans la langue de traduction, indiquant quâelles contiennent des informations classifiées reçues de la Partie dâorigine. 2. La traduction ou la reproduction des informations classifiées СТРÐÐÐ ÐÐÐÐÐ ÐÐÐÐ / SECRET LUX / SECRET ou de niveau supérieur sont autorisées uniquement avec lâaccord écrit préalable de la Partie dâorigine. Article 8 Destruction d'informations classifiées 1. Les informations classifiées sont détruites de manière à empêcher leur reconstitution intégrale ou partielle. 2. Les informations classifiées jusquâau niveau СТРÐÐÐ ÐÐÐÐÐ ÐÐÐÐ / SECRET LUX / SECRET sont détruites conformément aux lois et règlementations nationales. 3. Un rapport relatif à la destruction dâinformations classifiées est rédigé et sa traduction en langue anglaise est transmise à lâautorité compétente de la Partie dâorigine. 4. Les informations classifiées de niveau ÐÐ ÐÐÐÐРТÐÐÐÐ / TRÃS SECRET LUX / TOP SECRET ne sont pas détruites, sauf dans les cas mentionnés au paragraphe 5 du présent article, et sont renvoyées à lâautorité compétente de la Partie dâorigine. 5. Dans le cas dâune situation de crise rendant impossible la protection ou la rétrocession dâinformations classifiées, ces dernières sont immédiatement détruites. La Partie destinataire avise dès que possible lâautorité compétente de la Partie dâorigine dâune telle destruction. Article 9 Contrats classifiés 1. Les contrats classifiés seront conclus et exécutés conformément aux lois et réglementations nationales. 2. Sur demande, lâautorité compétente de la Partie destinataire confirme quâun contractant proposé sâest vu octroyer une habilitation de sécurité personnelle ou dâétablissement. Si le contractant proposé ne détient pas lâhabilitation de sécurité appropriée, lâautorité compétente de la Partie dâorigine peut demander à celle de la Partie destinataire dâétablir une telle habilitation. 3. Il incombe à lâautorité de sécurité compétente dont le territoire est visé par lâexécution du contrat classifié de prescrire et dâadministrer les mesures de sécurité applicables audit contrat selon les mêmes normes et les mêmes exigences que celles qui régissent la protection de ses propres contrats classifiés. Des inspections périodiques de la sécurité pourront être effectuées par les autorités de sécurité compétentes. 4. Une annexe relative à la sécurité fait partie intégrante de chaque contrat ou contrat de sous-traitance classifié. Dans cette annexe, la Partie dâorigine spécifie les informations classifiées qui doivent être divulguées à la Partie destinataire, le niveau de classification de sécurité qui leur a été attribué, ainsi que les obligations qui incombent au contractant eu égard à la protection des informations classifiées. La sous-traitance doit être explicitement autorisée dans lâannexe relative à la sécurité du contrat classifié. Une copie de lâannexe relative à la sécurité est transmise à lâautorité compétente de la Partie dâorigine. 5. Avant de transmettre aux contractants ou aux contractants éventuels de lâune des Parties toute information classifiée transmise par lâautre Partie, conformément à ses lois et réglementations nationales, la Partie destinataire sâassure que les contractants ou les contractants éventuels sont en mesure de protéger de façon appropriée les informations classifiées et : a) exécute une procédure dâhabilitation de sécurité dâétablissement appropriée à lâégard des contractants et des sous-traitants ; b) exécute une procédure dâhabilitation de sécurité individuelle appropriée à lâégard de tous les membres du personnel dont les fonctions requièrent un accès à des informations classifiées ; c) sâassure que toutes les personnes ayant accès à des informations classifiées sont tenues informées de leurs responsabilités ; d) réalise des inspections de sécurité périodiques au sein des établissements pertinents ayant obtenu une habilitation. 6. Les sous-traitants engagés au titre de contrats classifiés se conforment aux exigences de sécurité applicables aux contractants. 7. Les représentants des autorités compétentes peuvent effectuer des visites réciproques afin dâanalyser lâefficacité des mesures adoptées par un contractant pour garantir la protection des informations classifiées impliquées dans un contrat classifié. Article 10 Visites 1. Les visites liées aux contrats classifiés impliquant lâaccès à des informations classifiées sont soumises à lâautorisation écrite préalable de lâautorité compétente de la Partie hôte. 2. Lâautorité compétente de la Partie hôte reçoit la demande de visite au moins trois (3) semaines à lâavance. 3. Dans le cas dâune urgence, la demande de visite peut être transmise dans des délais plus courts. 4. Toute demande de visite contient les renseignements suivants : a) nom et prénom, date et lieu de naissance, citoyenneté, numéro du passeport ou du document dâidentité du visiteur ; b) nom de lâentité juridique que représente le visiteur et fonction du visiteur au sein de lâentité juridique ; c) nom, adresse et coordonnées de lâentité juridique à visiter ; d) informations relatives à lâhabilitation de sécurité individuelle du visiteur, à sa validité et au niveau de cette dernière ; e) objet et but de la visite ; f) date et durée prévues de la visite requise. Dans le cas de visites récurrentes, il convient d'indiquer la période totale couverte par les visites ; g) date, signature et sceau officiel de lâautorité compétente. 5. Une fois la visite autorisée, lâautorité compétente de la Partie hôte fournit une copie de la demande de visite aux responsables de la sécurité de lâentité juridique à visiter. 6. Les autorisations de visite sont valables un an au maximum. 7. Les autorités compétentes des Parties peuvent dresser des listes de personnes autorisées à effectuer des visites récurrentes. Les listes sont valides pour une période initiale de douze mois. Les conditions générales des visites respectives sont directement fixées par les points de contact appropriés de l'entité juridique que ces personnes doivent visiter, conformément aux modalités convenues. 8. Chacune des Parties garantit la protection des données personnelles des visiteurs conformément à ses lois et réglementations nationales. Article 11 Infraction à la sécurité 1. En cas dâinfraction à la sécurité avérée ou suspectée, lâautorité compétente de la Partie destinataire informe sans délai lâautorité compétente de la Partie dâorigine et ouvre une enquête appropriée. 2. Si une infraction à la sécurité est commise dans un Ãtat tiers, lâautorité compétente de la Partie dâorigine prend toutes les mesures nécessaires pour garantir la mise en Åuvre des actions visées au paragraphe 1. 3. Sur demande, la Partie dâorigine coopère à lâenquête, conformément au paragraphe 1. 4. La Partie dâorigine est tenue informée des résultats de lâenquête et reçoit le rapport final sur les raisons et lâétendue des dommages. Article 12 Frais Chacune des Parties supporte les frais propres encourus du fait de lâexécution et de la supervision du présent Accord. Article 13 Règlement des litiges Tout litige quant à lâinterprétation ou lâapplication du présent Accord est exclusivement résolu par voie de consultation et négociation entre les Parties. Lors de la phase de négociation, les deux Parties continuent à remplir toutes les autres obligations qui leur reviennent au titre du présent Accord. Article 14 Dispositions finales 1. Le présent Accord est conclu pour une durée indéterminée et prend effet le premier jour du deuxième mois qui suit la réception de la dernière des notifications écrites par lesquelles les Parties se sont tenues mutuellement informées, par la voie diplomatique, de lâaccomplissement des exigences légales nationales requises pour son entrée en vigueur. 2. Le présent Accord peut, à tout moment, être modifié dâun commun accord, par écrit, entre les Parties. Les modifications entrent en vigueur conformément au paragraphe 1. 3. Chacune des Parties peut, à tout moment, dénoncer le présent Accord moyennant une notification écrite transmise par la voie diplomatique, auquel cas la dénonciation prend effet six mois après la date de réception de la notification correspondante. 4. Nonobstant la dénonciation du présent Accord, les Parties garantissent que toutes les informations classifiées continuent dâêtre protégées jusquâà ce que la Partie dâorigine dispense la Partie destinataire de cette obligation. Fait à Luxembourg, le 4 février 2020, en double exemplaire, chacun en langues française, serbe et anglaise, tous les textes faisant également foi. Dans le cas dâun désaccord quant à lâinterprétation des dispositions du présent Accord, le texte anglais prévaut. Pour le Gouvernement du Grand-Duché de Luxembourg Pour le Gouvernement de la République de Serbie Philippe DONCKEL Ambassadeur du Grand-Duché de Luxembourg en République de Serbie Goran MATIÄ PhD Directeur de lâAutorité nationale de sécurité â AGREEMENT BETWEEN THE GOVERNMENT OF THE GRAND DUCHY OF LUXEMBOURG AND THE GOVERNMENT OF THE REPUBLIC OF SERBIA ON THE EXCHANGE AND MUTUAL PROTECTION OF CLASSIFIED INFORMATION The Government of the Grand Duchy of Luxembourg and The Government of the Republic of Serbia (hereinafter referred to as: âthe Partiesâ) Recognizing the need to set rules on protection of Classified Information mutually exchanged within the scope of political, military, security, economic, legal, scientific and technological or any other cooperation, as well as Classified Information generated in the process of such cooperation, Intending to ensure the mutual protection of all Classified Information that has been classified by one Party and transferred to the other Party, or jointly generated in the course of co-operation between the Parties, Desiring to establish a set of rules on the mutual protection of Classified Information to be generated or exchanged between the Parties, Considering the mutual interests in the protection of Classified Information, in accordance with national laws and regulations of the Parties, Have agreed as follows: Article 1 Objective and Scope 1. The objective of this Agreement is to ensure the protection of Classified Information that is jointly generated or exchanged between the Parties. 2. This Agreement shall be applicable to any activities, contracts or agreements involving Classified Information to be conducted or concluded between the Parties in the future. Article 2 Definitions For the purposes of this Agreement: a) âBreach of Securityâ means an act or an omission which is contrary to this Agreement or the national legislation of the Parties, the result of which may lead to disclosure, loss, destruction, misappropriation or any other type of compromise of Classified Information; b) âClassified Contractâ means an agreement between two or more Contractors or Subcontractors, which contains Classified Information or the implementation of which requires access to Classified Information; c) âClassified Informationâ means any information, regardless of its form, which is transmitted or generated between the Parties in accordance with national laws and regulations of either Party, which requires protection against unauthorized disclosure, misappropriation or loss and is designated as such; d) âCompetent Authorityâ means National Security Authority and any other competent entity which, in accordance with national laws and regulations, is responsible for the supervision of the implementation of this Agreement as referred to in Article 4, Paragraph 1 of this Agreement; e) âContractorâ means an individual or a legal entity possessing the legal capacity to conclude Classified Contracts; f) âFacility Security Clearanceâ means the determination by the Competent Authority confirming, in accordance with national laws and regulations that the Contractor or Subcontractor meets the physical and organizational capability to handle and store Classified Information up to a certain security classification level; g) âNeed-to-knowâ means the necessity to have access to specific Classified Information in the scope of given official duties and/or for the performance of a specific task; h) âOriginating Partyâ means the Party, including any entity which provides Classified Information in accordance with national laws and regulations; i) âPersonnel Security Clearanceâ means the determination by the Competent Authority confirming, in accordance with national laws and regulations that the individual is eligible to have access to Classified Information up to a certain security classification level; j) âReceiving Partyâ means the Party, including any entity to which Classified Information of the Originating Party is transmitted; k) âSub-contractorâ means a Contractor to whom a prime Contractor lets a sub-contract; l) âThird Partyâ means any state, organization, legal entity or individual, which is not a party to this Agreement. Article 3 Security Classification Levels The Parties agree that the following security classification levels and markings are equivalent and that they correspond to the security classification levels specified in their national legislation: For the Republic of Serbia For the Grand Duchy of Luxembourg Equivalent in English ÐÐ ÐÐÐÐРТÐÐÐÐ TRÃS SECRET LUX TOP SECRET СТРÐÐÐ ÐÐÐÐÐ ÐÐÐÐ SECRET LUX SECRET ÐÐÐÐÐ ÐÐÐÐ CONFIDENTIEL LUX CONFIDENTIAL ÐÐТÐÐ ÐÐ RESTREINT LUX RESTRICTED Article 4 Competent Authorities 1. The Competent Authorities of the Parties are: For the Government of the Republic of Serbia: KанÑелаÑиÑа СавеÑа за наÑÐ¸Ð¾Ð½Ð°Ð»Ð½Ñ Ð±ÐµÐ·Ð±ÐµÐ´Ð½Ð¾ÑÑ Ð¸ заÑÑиÑÑ ÑаÑÐ½Ð¸Ñ Ð¿Ð¾Ð´Ð°Ñака For the Government of the Grand Duchy of Luxembourg: Service de renseignement de lâÃtat Autorité nationale de sécurité 2. The Parties shall inform each other through diplomatic channels about any changes or modifications regarding their Competent Authorities. 3. The competent authorities shall inform each other of the laws and regulations in force in their states as well as any changes thereof affecting the protection of Classified Information generated or exchanged in accordance with this Agreement. 4. In order to achieve and maintain comparable standards of security, the Competent Authorities may provide each other with information about any security standards, procedures and practices for the protection of Classified Information employed by the respective Party. Article 5 Measures for the protection and the access to Classified Information 1. In accordance with their national laws and regulations, the Parties shall take all appropriate measures for the prevention of Classified Information, which is exchanged or generated under this Agreement. The same level of protection shall be ensured for such Classified Information as it is provided for the national Classified Information of the equivalent security classification level in accordance with Article 3 of this Agreement. 2. The Originating Party shall inform the Receiving Party in writing about any change of the security classification level of the transmitted Classified Information in order to apply the appropriate protection measures. 3. Classified Information shall only be made accessible to individuals who are authorized in accordance with national laws and regulations to have access to Classified Information of the equivalent security classification level and have a Need-to-know and who have been briefed accordingly. 4. Within the scope of this Agreement each Party shall recognize as equivalent the Personnel Security Clearances and Facility Security Clearances issued by the other Party in accordance with national laws and regulations. 5. The Competent Authorities shall, in accordance with national laws and regulations, assist each other upon request in carrying our vetting procedures necessary for the application of this Agreement. 6. Within the scope of this Agreement, the Competent Authorities of the Parties shall inform each other without delay about any alteration with regard to Personnel and Facility Security Clearances, in particular about their withdrawal or downgrading. 7. Upon request of the Competent Authority of the Originating Party, the Competent Authority of the Receiving Party shall issue a written confirmation that an individual has been issued a Personnel Security Clearance or a legal entity has been issued a Facility Security Clearance. 8. The Receiving Party shall: a) not disclose Classified Information to any Third Party without a prior written consent of the Originating Party issued in accordance with national laws and regulations; b) mark the received Classified Information in accordance with the equivalence set forth in Article 3; c) not declassify or downgrade the provided Classified Information without a prior written consent of the Originating Party; d) use Classified Information solely for the purposes it has been provided for. Article 6 Transmission of Classified Information 1. Classified Information shall be transmitted through diplomatic or military channels unless otherwise approved by the Competent Authorities in accordance with national laws and regulations. The Receiving Party shall confirm the receipt of Classified Information in writing. 2. Electronic transmission of Classified Information shall be carried out through certified cryptographic means agreed by the Competent Authorities in accordance with national laws and regulations. 3. The intelligence, security and police services of the Parties may, in accordance with national laws and regulations, exchange operational and/or intelligence information directly between each other. Article 7 Reproduction and Translation of Classified Information 1. Translations and reproductions of Classified Information shall be made in accordance with national laws and regulations of the Receiving Party and the following procedures: a) translations and reproductions shall be marked and protected as original Classified Information; b) translations and the number of copies shall be limited to that required for official purposes; c) translations shall bear an appropriate note in the language of the translation, indicating that it contains Classified Information received from the Originating Party. 2. Classified Information marked СТРÐÐÐ ÐÐÐÐÐ ÐÐÐÐ / SECRET LUX / SECRET or above shall be translated or reproduced only upon a prior written consent of the Originating Party. Article 8 Destruction of Classified Information 1. Classified Information shall be destroyed in a manner that prevents its partial or total reconstruction. 2. Classified Information marked up to СТРÐÐÐ ÐÐÐÐÐ ÐÐÐÐ/SECRET LUX/ SECRET shall be destroyed in accordance with national laws and regulations. 3. A report on destruction of Classified Information shall be made and its English translation shall be delivered to the Competent Authority of the Originating Party. 4. Classified Information marked ÐÐ ÐÐÐÐРТÐÐÐР/ TRÃS SECRET LUX/ TOP SECRET shall not be destroyed, except in cases referred to in paragraph 5 of this Article. It shall be returned to the Competent Authority of the Originating Party. 5. In case of a crisis situation in which it is impossible to protect or return Classified Information, it shall be destroyed immediately. The Receiving Party shall inform the Competent Authority of the Originating Party about this destruction as soon as possible. Article 9 Classified Contracts 1. Classified Contracts shall be concluded and implemented in accordance with national laws and regulations. 2. Upon request the Competent Authority of the Receiving Party shall confirm that a proposed Contractor has been issued an appropriate Personnel or Facility Security Clearance. If the proposed Contractor does not hold an appropriate security clearance, the National Security Authority of the Originating Party may request the Competent Authority of the Receiving Party to issue the appropriate security clearance. 3. The Competent Security Authority in the state territory of which the Classified Contract is to be performed, shall assume the responsibility for prescribing and administering security measures for the Classified Contract under the same standards and requirements that govern the protection of its own Classified Contracts. Periodical security inspections may be carried out by the Competent Security Authorities. 4. A security annex shall be an integral part of each Classified Contract or sub-contract by which the Originating Party shall specify which Classified Information is to be released to the Receiving Party, which security classification level has been assigned to that information and the Contractorâs obligations to protect the Classified Information. A copy of the security annex shall be sent to the Competent Authority of the Originating Party. 5. Prior to release to either Partyâs Contractors or prospective Contractors of any Classified Information received from the other Party, the Receiving Party shall, in accordance with its national laws and regulations, ensure that Contractors or prospective Contractors can afford adequate security protection to Classified Information and: a) perform an appropriate Facility Security Clearance procedure of the Contractors and Subcontractors; b) perform an appropriate Personnel Security Clearance procedure for all personnel whose duties require access to Classified Information; c) ensure that all persons having access to Classified Information are informed of their responsibilities; d) carry out periodic security inspections of relevant security-cleared facilities. 6. Sub-contractors engaged in Classified Contracts shall comply with the security requirements applied to the Contractors. 7. Representatives of the Competent Authorities may visit each other in order to analyze the efficiency of the measures adopted by a Contractor for the protection of Classified Infromation involved in a Classified Contract. Article 10 Visits 1. Visits related to Classified Contracts and involving access to Classified Information are subject to prior written approval given by the Competent Authority of the host Party. 2. The Competent Authority of the host Party shall receive a request for visit at least three (3) weeks in advance. 3. In urgent cases, the request for visit can be transmitted in shorter time. 4. The request for visit shall include: a) visitorâs name and surname, place and date of birth, citizenship, passport or identification document number; b) name of the legal entity represented by the visitor and position of the visitor in the legal entity; c) name, address and contact information of the legal entity to be visited; d) information on the visitorâs Personnel Security Clearance, its validity and level; e) object and purpose of the visit; f) expected date and duration of the requested visit. In case of recurring visits the total period covered by the visits shall be stated; g) date, signature and the official seal of the Competent Authority. 5. Once the visit has been approved the Competent Authority of the host Party shall provide a copy of the request for visit to the security officers of the legal entity to be visited. 6. The validity of visit approvals shall not exceed one year. 7. The competent Authorities of the Parties may draw up lists of individuals authorized to make recurring visits. The lists are valid for an initial period of twelve months. The terms of the respective visits shall be directly arranged with the appropriate points of contact in the legal entity to be visited by these individuals, in accordance with the terms and conditions agreed upon. 8. Each Party shall guarantee the protection of personal data of the visitors in accordance with national laws and regulations. Article 11 Breach of Security 1. In case of any suspicion or discovery of a Breach of Security the Competent Authority of the Receiving Party shall inform the Competent Authority of the Originating Party immediately, and initiate an appropriate investigation. 2. If a breach of security arises in a third state, the Competent Authority of the Originating Party shall take all necessary measures in order to ensure that the actions prescribed in Paragraph 1 are initiated. 3. The Originating Party shall, upon request, co-operate in the investigation in accordance with Paragraph 1. 4. The Originating Party shall be informed of the results of the investigation and shall receive the final report on the reasons and extent of the damage. Article 12 Expenses Each Party shall bear its own expenses incurred in the course of implementation and supervision of this Agreement. Article 13 Settlements of disputes Any dispute regarding the interpretation or application of this Agreement shall be settled by consultations and negotiations between the Parties. During the negotiations both Parties shall continue to fulfill all other obligations under the Agreement. Article 14 Final Provisions 1. This Agreement is concluded for an indefinite period of time and enters into force on the first day of the second month after the date of receipt of the latest written notification by which the Parties have notified each other, through diplomatic channels, that their national legal requirements necessary for its entry into force have been fulfilled. 2. This Agreement may be amended any time on the basis of mutual written approval of the Parties. The amendments shall enter into force in accordance with Paragraph1. 3. Each Party may, at any time, terminate this Agreement by written notification to the other Party, through diplomatic channels. In this case, the termination takes effect six months after the date of receipt of the respective notification. 4. Notwithstanding the termination of this Agreement, the Parties shall ensure that all Classified Information shall continue to be protected until the Originating Party dispenses the Receiving Party from this obligation. Done at Luxembourg on the 4 th of February 2020 in two original sets, each in the French, Serbian and English languages, all texts being equally authentic. In case of any divergence of interpretation, the English text shall prevail.
