This is the preamble to a Luxembourg law transposing an EU directive on the cross-border distribution of collective investment undertakings and amending two existing laws. This article says that Article 53 of the amended law of 17 December 2010 on undertakings for collective investment is replaced with the following wording. An OPCVM must set up arrangements in each Member State where it markets, or plans to market, its units so it can process subscriptions, redemptions and other payments, inform investors, share required documents, provide contact details, and act as a contact point for authorities. An UCITS (OPCVM) must notify the CSSF and the host-state competent authorities in writing at least one month before changing the notified information or the share categories to be marketed. The CSSF must respond within 15 working days after receiving all information, and may take measures if a change leads to non-compliance. An OPCVM may withdraw its marketing notification for units in a Member State if it meets listed conditions, and it must notify the CSSF and stop new or additional offering or placement in that State.
