Statute overview
About this statute
This preamble identifies the regulation and lists the legal bases and consulted opinions behind it. The financial guarantee device covered here must take the form of a Protection and Indemnity liability insurance policy with one or more providers. Le prestataire de la garantie financière doit traiter rapidement et impartialement les demandes d’indemnisation, payer sans retard les indemnités prévues, éviter toute pression pour accepter moins, et verser des paiements provisoires dans certains cas. A Luxembourg-flagged ship must keep its financial-guarantee certificates or other proof on board, include the required Annex A4-I information, provide them in English or with an English translation, and display a copy clearly on the ship. A financial guarantee cannot end before its validity period ends unless the provider has notified the commissioner and the shipowner in time; the shipowner must then notify seafarers.
