About this statute

This section gives the Act’s short title: the Service of Process and Execution of Judgments Act. This section defines key terms used in the Act, including court, defendant, party, plaintiff, proper officer, suit, and summons. If a summons or other process (other than a subpoena) must be served in Malawi in a suit in Southern Rhodesia or Zambia, the service may be done in the prescribed manner and by the prescribed person. Summons served under this Part must include specified endorsements and a short statement of the claim or relief sought; if the plaintiff sues representatively, the summons must state that capacity. A summons or copy without the endorsements or annexures required by this Part is ineffective for service under this Part.
