About this statute
This section gives the Act’s short title: the Investment Disputes (Enforcement of Awards) Act. This section defines several terms used in the Act, including Award, Convention, Investment Dispute, party, and Secretary General. An award is binding on the parties. A party may ask the High Court to register an Award within six years of the Award date, or later if the Court allows. The application must include specified documents and statements, and the applicant must provide certified translations for foreign-language documents. If an Award is registered under section 4, it has the same effect as a High Court judgment for enforcing pecuniary obligations in Malawi, and reasonable registration costs are recoverable.
