This section says the Act may be cited as the Extradition Act. This section defines key terms used in the Act, including court, designated country, fugitive offender, relevant offence, and warrant. The Minister may make extradition arrangements with other countries and, by order, designate countries to which the Act applies, with specified conditions or exceptions. A fugitive offender from a designated country may be arrested, detained, and surrendered to that country under this Act. An offence counts as a relevant offence only if it matches a Second Schedule description, is punishable by at least 12 months’ imprisonment (or more), and would also be an offence in Malawi in the relevant circumstances.
