About this statute

This section says the Act may be cited as the Commercial Credits Act. This section defines terms used in the Act, including business proprietor, commercial charge, designated institution, register, registered, and trading assets. A business proprietor may create a written commercial charge over trading assets in favour of a designated institution. A fixed charge gives the designated institution rights to take possession and sell charged property, and requires payment and distribution of sale or insurance proceeds in specified ways. A floating charge generally has the same effect as a registered debenture, and it turns into a fixed charge on certain events. While it remains floating, the business proprietor must pay over certain sale, trading-asset, and insurance proceeds to the designated institution, unless the money is used to buy new trading assets that then become subject to the charge.
