About this statute

This section gives the Act its short title: the Hijacking Act. This section defines key terms used in the Act and explains when an aircraft counts as being “in flight” or “in service.” Any person who unlawfully commits certain acts against an aircraft, air navigation facilities, or onboard safety commits an offence and is liable to imprisonment for life. Acts on board a Malawian aircraft outside Malawi can still count as offences in Malawi if they would be offences under Malawian law, unless the act is authorized outside Malawi. For jurisdiction purposes, an offence under section 4(2) is treated as having been committed wherever the accused is.
