About this statute

This part of the Act says personal data processing in commercial transactions is regulated, and users of data must follow the data protection principles, give notices, protect data, and respect access and disclosure rules. A data user must notify a requester or data subject in writing within set time limits, correct inaccurate personal data when required, stop processing after consent is withdrawn, and restrict sensitive-data processing unless a stated condition applies. A data user generally may not transfer personal data outside Malaysia unless the destination is approved by the Minister on the Commissioner’s recommendation, or one of the stated exceptions applies. This provision prohibits unauthorized collection, disclosure, sale, or attempted sale of personal data and sets offences, penalties, and enforcement powers.
