NOTA VAN TOELICHTING Artikel 13, onderdeel 4, van de Wet bestuursrechtelijke aanpak online kinderpornografisch materiaal voegt een nieuwe bepaling toe aan het Wetboek van Strafrecht, namelijk artikel 253a inhoudende – kort gezegd – een verbod op kindersekspoppen. Onderdeel 5 van artikel 13 voorziet in een strafmaximumverhoging indien dit feit wordt gepleegd onder de omstandigheden, bedoeld in artikel 254, eerste lid, onderdeel c, van het Wetboek van Strafrecht. De Wet bestuursrechtelijke aanpak online kinderpornografisch materiaal is grotendeels per 1 juli 2024 in werking getreden. Zoals aangegeven in de toelichting bij het inwerkingtredingsbesluit van destijds (Stb. 2024, 186) kunnen onderdelen 4 en 5 van artikel 13 pas in werking treden nadat artikel 13, onderdeel 4, aan de Europese Commissie is genotificeerd en de notificatieprocedure is afgerond. De notificatie van de verbodsbepaling door de Nederlandse Staat aan de Europese Commissie heeft op 10 juli 2024 plaatsgevonden. De zogenoemde «standstill periode» waarbinnen de Europese Commissie en de lidstaten op het genotificeerde voorstel konden reageren is op 11 oktober 2024 verstreken. Nu er geen reactie op het voorstel is ontvangen door de Nederlandse Staat, kan het voorgestelde verbod op kindersekspoppen in werking treden.1Nadere informatie over de notificatie van artikel 13, onderdeel 4, is te vinden op: https://technical-regulation-information-system.ec.europa.eu/nl/notification/26063. Gekozen is voor inwerkingtreding op het eerstvolgende vaste verandermoment, namelijk 1 januari 2025.
