NOTA VAN TOELICHTING Dit besluit regelt de inwerkingtreding artikel XXXI, onderdelen B en F, artikel XXXIV en artikel XXXVI van het Belastingplan 2021. Artikel XXXI, onderdelen B en F, artikel XXXIV en artikel XXXVI van het Belastingplan 2021 treden in werking met ingang van 1 oktober 2021. Deze onderdelen wijzigen de Wet belastingen op milieugrondslag (Wbm) waarmee er een verlaagd tarief in de energiebelasting wordt geïntroduceerd voor elektriciteit geleverd aan walstroominstallaties. Inwerkingtreding van deze onderdelen geschiedt bij koninklijk besluit omdat voor het verlaagd tarief een derogatie van de Richtlijn Energiebelastingen1Richtlijn 2003/96/EG van de Raad van 27 oktober 2003 tot herstructurering van de communautaire regeling voor de belasting van energieproducten en elektriciteit (PbEU 2011, L 283). verkregen moest worden. Deze derogatie is op 7 juni 2021 verleend en geldt van 1 juli 2021 tot en met 30 juni 2027.2Uitvoeringsbesluit (EU) 2021/921 van de Raad van 7 juni 2021 (PbEU 2021, LI 203/1). Met inwerkingtreding van deze bepalingen uit het Belastingplan 2021 treedt ook artikel XVIII, onderdelen A en E, Regeling van de Staatssecretaris van Financiën van 31 december 2020 tot wijziging van onder meer enige uitvoeringsregelingen op het gebied van belastingen en toeslagen (nr. Nr. 2020-0000246185) in werking. Met de inwerkingtreding per 1 oktober 2021 wordt afgeweken van de vaste verandermomenten zoals opgenomen in de aanwijzingen voor de regelgeving. Dit wordt in dit geval gerechtvaardigd geacht gezien de afspraken over de walstroommaatregel in de Green Deal Zeevaart, Binnenvaart en Havens. Wel wordt voldaan aan de minimuminvoeringstermijn van twee maanden. Wat de gevolgen voor de uitvoerbaarheid betreft, is er geen aanvullende impact ten opzichte van de bij het wetsvoorstel eerder opgestelde uitvoeringstoets.3Bijlage bij kamerstukken 2020/21, 35 572 nr. 3 Ten overvloede wordt opgemerkt dat in het Belastingplan 2021 de mogelijkheid is opgenomen om de vernummering in artikel 47 Wbm in dit besluit aan te passen. Aangezien dit niet nodig is, wordt hiervan geen gebruik gemaakt.
