Przy przesłuchaniu świadka, który w chwili przesłuchania nie ukończył 18. roku życia, nie może być obecny obwiniony. W trakcie przesłuchiwania świadka, o którym mowa w ust. 2, obecny jest psycholog, a w razie potrzeby także rodzic, opiekun prawny lub osoba (podmiot) sprawująca pieczę zastępczą, jeżeli nie ogranicza to swobody wypowiedzi przesłuchiwanego. Rozporządzenie wchodzi w życie po upływie 30 dni od dnia ogłoszenia.
