Do postępowania przed Sądem Najwyższym stosuje się przepisy ustawy z dnia 17 listopada 1964 r. - Kodeks postępowania cywilnego (Dz. U. z 2018 r. poz. 1360, z późn. zm.1)Zmiany tekstu jednolitego wymienionej ustawy zostały ogłoszone w Dz. U. z 2018 r. poz. 1467, 1499, 1544, 1629, 1637, 1693, 2385 i 2432 oraz z 2019 r. poz. 55 i 60.) o skardze kasacyjnej. Przepisu art. 871 tej ustawy nie stosuje się. uchyla się ust. 4. W ustawie z dnia 25 lipca 2002 r. - Prawo o ustroju sądów administracyjnych (Dz. U. z 2018 r. poz. 2107 oraz z 2019 r. poz. 125) w art. 49 zdanie pierwsze otrzymuje brzmienie: W sprawach nieuregulowanych w ustawie, do Naczelnego Sądu Administracyjnego oraz do sędziów, urzędników i pracowników tego Sądu, stosuje się odpowiednio przepisy dotyczące Sądu Najwyższego, z wyjątkiem przepisu art. 44 ust. 1 zdanie drugie ustawy z dnia 12 maja 2011 r. o Krajowej Radzie Sądownictwa (Dz. U. z 2019 r. poz. 84, 609, 730 i 914). Postępowania w sprawach odwołań od uchwał Krajowej Rady Sądownictwa w sprawach indywidualnych dotyczących powołania do pełnienia urzędu na stanowisku sędziego Sądu Najwyższego, wszczęte i niezakończone przed dniem wejścia w życie niniejszej ustawy, podlegają umorzeniu z mocy prawa. Ustawa wchodzi w życie po upływie 7 dni od dnia ogłoszenia.
