Oświadczenie rządowe z dnia 17 czerwca 2021 r. w sprawie mocy obowiązującej Konwencji o ochronie podwodnego dziedzictwa kulturowego, przyjętej w Paryżu dnia 2 listopada 2001 r.

Oświadczenie Rządowez dnia 17 czerwca 2021 r.w sprawie mocy obowiązującej Konwencji o ochronie podwodnego dziedzictwa kulturowego, przyjętej w Paryżu dnia 2 listopada 2001 r. Treść oświadczenia Podaje się niniejszym do wiadomości, że na podstawie ustawy z dnia 27 października 2020 r. o ratyfikacji Konwencji o ochronie podwodnego dziedzictwa kulturowego, przyjętej w Paryżu dnia 2 listopada 2001 r. (Dz. U. poz. 2201) Prezydent Rzeczypospolitej Polskiej dnia 18 marca 2021 r. ratyfikował wyżej wymienioną konwencję. Zgodnie z art. 27 zdanie pierwsze konwencji weszła ona w życie dnia 2 stycznia 2009 r. Zgodnie z art. 27 zdanie drugie konwencji w stosunku do Rzeczypospolitej Polskiej wchodzi ona w życie dnia 18 sierpnia 2021 r. Algierskie Dowództwo Sił Zbrojnych (Ministerstwo Obrony Narodowej) jest odpowiedzialne za przekazanie zgłoszenia wszystkim Państwom-Stronom. W odniesieniu do art. 28 Konwencji Algierska Republika Ludowo-Demokratyczna deklaruje, że Zasady Konwencji mają zastosowanie do jej wód śródlądowych, niebędących wodami morskimi. Declarations: With reference to Article 9 paragraph 2 of the Convention the People’s Democratic Republic of Algeria declares that, pursuant to paragraph 1(b) of that Article, the People’s Democratic Republic of Algeria, a State Party to the Convention, designates the Algerian Naval Forces Command (Ministry of National Defence) as the sole addressee of information concerning discovery or activity directed at the underwater cultural heritage situated in the Exclusive Economic Zone (EEZ) or on the continental shelf of another State Party. The Algerian Naval Forces Command (Ministry of National Defence) is charged with forwarding the declaration to all States Parties. With reference to Article 28 of the Convention the People’s Democratic Republic of Algeria declares that the Rules of the Convention shall apply to its inland waters not of a maritime character. Królestwo Arabii Saudyjskiej Deklaracja: Zgodnie z art. 9 ust. 2 Konwencji Królestwo wymaga, aby jego poddani i kapitanowie statków pływających pod jego banderą zgłaszali każde odkrycie lub działania dotyczące podwodnego dziedzictwa znajdującego się w wyłącznej strefie ekonomicznej lub na szelfie kontynentalnym innego Państwa-Strony, oraz że Królestwo zobowiązuje się do informowania innych Państw-Stron. Declaration: Pursuant to Article 9 paragraph 2 of the Convention the Kingdom shall require that its subjects and captains of ships flying its flag declare any discovery or activity concerning underwater heritage located in the exclusive economic zone or on the continental shelf of another State Party, and that the Kingdom will undertake to inform the other States Parties. Republika Argentyńska Deklaracje: Republika Argentyńska wybrała procedurę zgłaszania przewidzianą w art. 9 ust. 1 lit. b) tiret (ii) Konwencji. Republika Argentyńska uznaje, że art. 26 ust. 2 lit. b) Konwencji oraz związany z nim art. 1 ust. 2 lit. b) Konwencji nie znajdują zastosowania do terytoriów będących przedmiotem sporu co do ich suwerenności uznawanego przez Zgromadzenie Ogólne Narodów Zjednoczonych. Republika Argentyńska przypomina, że Falklandy (Malwiny), wyspy Georgia Południowa i Sandwich Południowy oraz otaczające obszary morskie stanowią integralną część jej terytorium i jako nielegalnie okupowane przez Zjednoczone Królestwo Wielkiej Brytanii i Irlandii Północnej są przedmiotem sporu dotyczącego suwerenności uznawanego przez społeczność międzynarodową. W tym względzie Zgromadzenie Ogólne przyjęło rezolucje 2065 (XX), 3160 (XXVIII), 31/49, 37/9, 38/12, 39/6, 40/21, 41/40, 42/19 i 43/25, w których uznaje istnienie sporu dotyczącego suwerenności określanego jako „Kwestia Falklandów (Malwinów)” i wzywa rządy Republiki Argentyńskiej i Zjednoczonego Królestwa Wielkiej Brytanii i Irlandii Północnej, aby wznowiły negocjacje w celu jak najszybszego znalezienia pokojowego, sprawiedliwego i ostatecznego rozstrzygnięcia sporu. Również Specjalny Komitet Dekolonizacyjny Organizacji Narodów Zjednoczonych wielokrotnie przedstawiał podobne wezwania. Declarations: The Republic of Argentina has selected the reporting procedure provided for in Article 9 paragraph 1 (b) (ii) of the Convention. The Republic of Argentina considers that Article 26 paragraph 2 (b) of the Convention and the correlative Article 1 paragraph 2 (b) of the Convention are not applicable to territories subject to a sovereignty dispute recognized by the United Nations General Assembly. The Republic of Argentina recalls that the Falkland Islands (Malvinas), South Georgia and the South Sandwich Islands and the surrounding maritime areas are an integral part of its territory and as they are illegally occupied by the United Kingdom of Great Britain and Northern Ireland they are the subject of a sovereignty dispute recognized by the international community. In that regard, the General Assembly has adopted resolutions 2065 (XX), 3160 (XXVIII), 31/49, 37/9, 38/12, 39/6, 40/21, 41/40, 42/19 and 43/25 in which it recognizes the existence of a sovereignty dispute referred to as the “Question of the Falkland Islands (Malvinas)” and urges the governments of the Republic of Argentina and the United Kingdom of Great Britain and Northern Ireland to resume negotiations in order to find as soon as possible a peaceful, fair and definitive solution to the dispute. The United Nations Special Committee on Decolonization, too, has repeatedly made similar calls. Królestwo Belgii Deklaracja: Odnosząc się do art. 28 Konwencji Królestwo Belgii deklaruje, że Zasady Konwencji mają zastosowanie do jego wód śródlądowych, niebędących wodami morskimi. Declaration: Referring to Article 28 of the Convention the Kingdom of Belgium declares that the Rules of the Convention apply to its inland waters which are not of a maritime character. Republika Estońska Deklaracje: Republika Estońska deklaruje na podstawie art. 9 ust. 2 Konwencji, że informacje, o których mowa w art. 9 ust. 1 lit. b) Konwencji, będą przekazywane w sposób wskazany w art. 9 ust. 1 tiret (ii). Republika Estońska deklaruje na podstawie art. 28 Konwencji, że Zasady Konwencji mają zastosowanie do jej wód śródlądowych, niebędących wodami morskimi. Declarations: Republic of Estonia declares in accordance with Article 9 paragraph 2 of the Convention that the information referred to in Article 9 paragraph 1 (b) will be transmitted in the manner stipulated in Article 9 paragraph 1 subparagraph (ii). The Republic of Estonia declares in accordance with Article 28 of the Convention that the Rules of the Convention shall apply to its inland waters not of a maritime character. Republika Gwatemali Deklaracje: Republika Gwatemali deklaruje, że sposób, w jaki będzie przekazywać informacje, o których mowa w art. 9 ust. 1 lit. b) Konwencji, będzie taki, jak określono w tiret (ii) tego ustępu. W celach stosowania postanowień art. 25 ust. 4 Konwencji Republika Gwatemali deklaruje, że zastrzega sobie prawo do rozważenia każdej z procedur rozstrzygania sporów zgodnie z art. 287 Konwencji Narodów Zjednoczonych o prawie morza, stosownie do tego, co może zostać uzgodnione w każdym indywidualnym przypadku. Zgodnie z art. 28 Konwencji Republika Gwatemali deklaruje, że Zasady Konwencji mają zastosowanie do wód śródlądowych, niebędących wodami morskimi. Ratyfikacja niniejszej Konwencji nie stanowi całkowitego lub częściowego zrzeczenia się suwerenności Państwa Gwatemali w stosunku do jakiegokolwiek terytorium (lądowego, wyspiarskiego lub morskiego), które się tego domaga; nie będzie to również naruszać jakiegokolwiek prawa Państwa Gwatemala w stosunku do każdego z takich terytoriów; nie będzie też stanowić precedensu dla wzmocnienia lub osłabienia jego praw do jakiegokolwiek terytorium. Republika Gwatemali kategorycznie zastrzega sobie prawo odnoszące się do jej roszczeń co do suwerenności nad jakimkolwiek terytorium (lądowym, wyspiarskim lub morskim). Declarations: The Republic of Guatemala declares that the way in which it will transmit the information provided for in paragraph 1(b) of Article 9 paragraph 1 of the Convention shall be that provided for in subparagraph (ii) of that paragraph. For the purposes of the provisions of Article 25 paragraph 4 of the Convention, the Republic of Guatemala declares that it reserves the right to consider any of the dispute settlement procedures pursuant to Article 287 of the United Nations Convention on the Law of the Sea, according to what may be agreed in each individual case. Pursuant to Article 28 of the Convention the Republic of Guatemala declares that the Rules of the Convention shall apply to inland waters not of a maritime character. The ratification of this Convention shall not constitute a total or partial renunciation of the sovereignty of the State of Guatemala over any territory (land, insular or maritime) which it claims; neither shall it be to the detriment of any right of the State of Guatemala over any such territory; nor shall it constitute a precedent for the strengthening or weakening of its claim over any territory. The Republic of Guatemala explicitly reserves its rights with respect to its claims of sovereignty over any territory (land, insular or maritime). Republika Kuby Deklaracje: Republika Kuby deklaruje, że zgodnie z art. 9 ust. 2 Konwencji przekaże stosowne informacje dotyczące wszelkich odkryć lub działań związanych z podwodnym dziedzictwem kulturowym w wyłącznej strefie ekonomicznej lub na szelfie kontynentalnym innego Państwa-Strony, w formie dokumentu wydanego przez Biuro Przewodniczącego Krajowej Komisji Zabytków i zatwierdzonego przez Radę Narodowego Dziedzictwa Kulturowego Ministerstwa Kultury. Republika Kuby, w związku z art. 25 ust. 3 Konwencji odnoszącym się do stosowania mutatis mutandis przepisów dotyczących rozstrzygania sporów określonych w części XV Konwencji Narodów Zjednoczonych o prawie morza, deklaruje, że potwierdza oświadczenie złożone na podstawie art. 287 tej Konwencji, dotyczące nieuznawania jurysdykcji Międzynarodowego Trybunału Sprawiedliwości i w konsekwencji nieuznawania jurysdykcji tego Trybunału w odniesieniu do postanowień art. 297 i art. 298 tejże Konwencji. Declarations: The Republic of Cuba declares that, pursuant to Article 9 paragraph 2 of the Convention, it will transmit the relevant information on any discovery or activity relating to the underwater cultural heritage in the exclusive economic zone or on the continental shelf of another State Party by means of a document issued by the Office of the President of the National Commission of Monuments and endorsed by the National Cultural Heritage Council of the Ministry of Culture. The Republic of Cuba, in regard to Article 25 paragraph 3 of the Convention relating to the application mutatis mutandis of the provisions on the settlement of disputes set out in Part XV of the United Nations Convention on the Law of the Sea, declares that it reaffirms the declaration made under Article 287 of the Convention, concerning its non-acceptance of the jurisdiction of the International Court of Justice and, consequently, its non-acceptance of the Court’s jurisdiction over the provisions of Articles 297 and 298 of the Convention. Republika Panamy Deklaracja: Republika Panamy deklaruje, że sprawuje wyłączną zwierzchność nad Zatoką Panamską, pod względem naturalnym i historycznym będącą zatoką panamską, której wybrzeża przynależą w całości do Republiki Panamy. Jest to ściśle określony region geograficzny, będący szerokim wyżłobieniem w południowej części Przesmyku Panamskiego, z wodami morskimi pokrywającymi dno morskie i jego zawartość w obszarze między równoleżnikami 07°28’00” i 07°31’00” szerokości geograficznej północnej oraz południkami 79°59’53” i 78°11’40” długości geograficznej na zachód od Greenwich. Określają one położenie Punta Mala i Punta Jaqué, odpowiednio u zachodniego i wschodniego wejścia do Zatoki Panamskiej. To szerokie wcięcie wchodzi głęboko w obszar lądowy Przesmyku Panamskiego. Szerokość wejścia, od Punta Mala do Punta Jaqué, wynosi około dwieście kilometrów (200 km), a długość w stronę lądu (mierzona od hipotetycznej linii łączącej Punta Mala i Punta Jaqué aż do ujścia Río Chico, na wschód od miasta Panama) wynosi sto sześćdziesiąt pięć kilometrów (165 km). Biorąc pod uwagę obecne i potencjalne zasoby, Zatoka Panamska, zatoka historyczna, od niepamiętnych czasów ma żywotne znaczenie dla Republiki Panamy, zarówno ze względów bezpieczeństwa i obrony, jak i gospodarczych, gdyż jej zasoby morskie od dawna były wykorzystywane przez mieszkańców Przesmyku Panamskiego. Podłużnego kształtu, z linią brzegową przypominającą nieco głowę cielęcia, Zatoka posiada obwód w granicach panamskiej jurysdykcji morskiej wynoszący około sześćset sześćdziesiąt osiem kilometrów (668 km). W tych granicach Zatoka Panamska, zatoka historyczna, ma obszar około trzydziestu tysięcy kilometrów kwadratowych (30 000 km˛). Republika Panamy deklaruje, że korzystając ze swoich suwerennych praw i uprawnień jurysdykcyjnych oraz wypełniając swoje obowiązki będzie postępować zgodnie z postanowieniami Konwencji, zastrzegając sobie prawo do wydawania innych deklaracji, gdy zajdzie taka potrzeba. Declaration: The Republic of Panama declares that it has sole sovereignty over the Gulf of Panama, by nature and history a Panamanian bay, whose coasts belong in their entirety to the Republic of Panama. It is a clearly defined geographic configuration, being a large scooped-out incurvation to the south of the Isthmus of Panama, with sea waters underlying the seabed and its subsoil in the area between latitudes 07°28’00” North and 07°31’00” North, and longitudes 79°59’53” and 78°11’40”, both West of Greenwich. These determine the location of Punta Mala and Punta Jaqué, at the West and East of the entrance of the Gulf of Panama respectively. This large indentation cuts well into the land area of the Isthmus of Panama. The width of its entrance, from Punta Mala to Punta Jaqué, is about two hundred kilometres (200 kms) and its extension inland (measured from an imaginary line linking Punta Mala and Punta Jaqué up to the mouths of the Río Chico, east of Panama City) is one hundred and sixty-five kilometres (165 kms). In view of its current and potential resources the Gulf of Panama, a historic bay, has been a vital necessity for the Republic of Panama since time immemorial, both with regard to its security and defence and to the economic field, since its marine resources have long been used by the inhabitants of the Isthmus of Panama. Oblong in shape, with a coastal outline which somewhat resembles a calf’s head, the Gulf has a coastal perimeter under Panamanian sea control of some six hundred and sixty-eight kilometres (668 kms). Within this demarcation, the Gulf of Panama, a historic bay, has an area of approximately thirty thousand square kilometres (30,000 kms˛). The Republic of Panama declares that in the exercise of its sovereign and jurisdictional rights and the accomplishment of its duties, it will act in accordance with the provisions of the Convention, reserving the right to issue other related declarations, should the need arise. Republika Portugalska Deklaracja: Zgodnie z art. 9 ust. 2 Konwencji Republika Portugalska deklaruje, że informacje, o których mowa w ust. 1 lit. b) tego artykułu, będą przekazane w sposób określony w tiret (ii). Declaration: Pursuant to Article 9 paragraph 2 of the Convention, the Portuguese Republic declares that the information referred to in paragraph 1(b) of that same article will be transmitted in the manner stipulated in subparagraph (ii). Konfederacja Szwajcarska Declaration: Na podstawie art. 28 Konwencji Szwajcaria deklaruje, że Zasady, o których mowa w art. 33 Konwencji, stosuje się do wód śródlądowych. Declaration: Se fondant sur l’art. 28 de la Convention la Suisse déclare que les Règles au sens de l’art. 33 de la Convention s’appliquent à ses eaux intérieures. Ukraina Deklaracje: Zgodnie z art. 9 i 11 Konwencji Ukraina deklaruje niniejszym, że w przypadku odkrycia podwodnego dziedzictwa kulturowego w wyłącznej strefie ekonomicznej lub na szelfie kontynentalnym Państwa-Strony lub w Obszarze, a także jeżeli powstanie zamiar przeprowadzenia działań nakierowanych na to podwodne dziedzictwo kulturowe, zapewni szybkie i skuteczne przekazywanie informacji o powyższym do wszystkich Państw-Stron oraz do Dyrektora Generalnego UNESCO za pośrednictwem Narodowej Komisji Ukrainy do spraw UNESCO. Zgodnie z art. 22 Konwencji Ukraina deklaruje, że właściwą władzą upoważnioną zgodnie z art. 22 Konwencji będzie główny organ wykonawczy w zakresie ochrony dziedzictwa kulturowego. Zgodnie z art. 28 Konwencji Ukraina deklaruje, że Zasady Konwencji będą stosowane do wód śródlądowych, niebędących wodami morskimi. Declarations: Pursuant to Articles 9 and 11 of the Convention Ukraine declares that in case of discovery of the underwater cultural heritage in the exclusive economic zone or on the continental shelf of a State Party or in the Area, or if there is an intention to carry out, there, activities directed towards the underwater cultural heritage, it shall provide the rapid and effective transmission of information about the aforesaid to all the States Parties and to the Director General of UNESCO through the National Commission of Ukraine on Affairs of UNESCO. Pursuant to Article 22 of the Convention Ukraine declares that the competent authority authorized in accordance with Article 22 of the Convention shall be the central executive authority in the sphere of the protection of the cultural heritage. Pursuant to Article 28 of the Convention Ukraine declares that the Rules of the Convention shall be implemented to the inland waters not of a maritime character. Republika Włoska Deklaracja: Republika Włoska deklaruje, że zgłoszenia na podstawie art. 9 ust. 1 lit. b) Konwencji będą przekazywane w sposób określony w ust. 1 lit. b) tiret (ii) tegoż art. 9. Declaration: The Republic of Italy declares that the reports under Article 9 paragraph 1(b) of the Convention will be transmitted in the manner stipulated in paragraph 1(b), (ii) of that same Article 9.
