The text of Item 5 of Article 75 of the Law of Civil Service, referred to above, shall be replaced with the following text: “ 5- Removal not by means of a disciplinary based onthe requirements of public interest. In all cases, such removal shall be bydecision of the Prime Minister upon proposal of the competent minister or higher president of other government agencies, and this decision shall be considered as final and irrevocable, without prejudice to the right of the removed employee in claiming for a compensation where necessary. A committee,whose formation, procedures to be followed, and how performing the functions shall be issued by Emiri Resolution, shall be specialised, alone, in considering the application for compensation. ” All competent authorities, each within its own jurisdiction, shall enforce this Law which shall come into force from the date of its publication in the Official Gazette. --- يستبدل بنص البند (5) من المادة (75) من قانون الوظائف العامة المدنية المشار إليه، النص التالي: «(5) الفصل بغير الطريق التأديبي بناء على مقتضيات الصالح العام. ويجب في جميع الأحوال، أن يكون هذا الفصل بقرار من رئيس مجلس الوزراء بناء على اقتراح الوزير المختص أو الرئيس الأعلى في الأجهزة الحكومية الأخرى، ويكون هذا القرار نهائياً غير قابل للإلغاء، دون الإخلال بحق المفصول في المطالبة بالتعويض إذا كان لذلك مقتض. وتختص بالنظر في طلب التعويض، وحدها دون غيرها، لجنة يصدر بتشكيلها وبيان الإجراءات التي تتبع أمامها، وكيفية أدائها لعملها قرار أميري». على جميع الجهات المختصة، كل فيما يخصه، تنفيذ هذا القانون. ويعمل به من تاريخ صدوره. وينشر في الجريدة الرسمية.
