ЗАКОН РОССИЙСКОЙ ФЕДЕРАЦИИ О выплате пенсий гражданам, выезжающим на постоянное жительство за пределы Российской Федерации Статья 1. Гражданам, выезжающим на постоянное жительство за пределы Российской Федерации, перед отъездом выплачиваются суммы назначенных пенсий (независимо от вида пенсий) в российских рублях за шесть месяцев вперед. Статья 2. На основании письменного заявления гражданина, выезжающего на постоянное жительство за пределы Российской Федерации, сумма назначенной пенсии может переводиться за границу в иностранной валюте по курсу рубля, устанавливаемому Центральным банком Российской Федерации на день совершения операции. При этом ее перевод производится начиная с месяца, следующего за месяцем отъезда этого гражданина за пределы Российской Федерации, но не ранее чем со дня, до которого выплачена пенсия в российских рублях. Статья 3. Порядок выплаты пенсий в соответствии с настоящим Законом устанавливается Советом Министров - Правительством Российской Федерации по согласованию с Пенсионным фондом Российской Федерации. Статья 4. При возвращении граждан на постоянное жительство в Российскую Федерацию суммы назначенных пенсий, не полученные ими за время их проживания за пределами Российской Федерации, выплачиваются в порядке, установленном законодательством Российской Федерации. Статья 5. Действие настоящего Закона не распространяется на граждан, выехавших на постоянное жительство за пределы Российской Федерации, если в отношении этих граждан законодательством Российской Федерации или межгосударственным договором (соглашением) установлен иной порядок пенсионного обеспечения.
