This article establishes a Subcommittee on Prevention and requires it to work under UN principles, follow confidentiality and impartiality standards, and cooperate with States Parties. The Protocol’s purpose is to create a system of regular visits by independent international and national bodies to places where people are deprived of liberty, to help prevent torture and other cruel, inhuman, or degrading treatment or punishment. Each State Party must set up, designate, or maintain one or more domestic visiting bodies to prevent torture and other cruel, inhuman, or degrading treatment or punishment. Each State Party must allow the specified mechanisms to visit places of detention and must give them broad access, subject to a narrow security-based exception. The article sets the Subcommittee on Prevention at 10 members, later increasing to 25 after the 50th ratification or accession, and sets rules for electing and composing the committee.
