This article defines key terms used in the Convention. States establish diplomatic relations and permanent diplomatic missions by mutual consent. A diplomatic mission may carry out core diplomatic functions, including representation, protection, negotiation, information gathering, reporting, and promoting relations. The sending State must ensure the receiving State has approved the person it wants to appoint as head of mission. The sending State may notify the receiving States and then accredit one head of mission or diplomatic staff member to more than one State, unless a receiving State expressly objects.

Heads of mission are grouped into three classes, and apart from precedence and etiquette they are not treated differently because of their class.

§ 1Article 1Provision

States establish diplomatic relations and permanent diplomatic missions by mutual consent.

A diplomatic mission may carry out core diplomatic functions, including representation, protection, negotiation, information gathering, reporting, and promoting relations.

§ 4Article 4Provision

The sending State must ensure the receiving State has approved the person it wants to appoint as head of mission.

§ 5Article 5Provision

The sending State may notify the receiving States and then accredit one head of mission or diplomatic staff member to more than one State, unless a receiving State expressly objects.

Two or more States may accredit the same person as head of mission to another State, unless the receiving State objects.

The sending State may appoint mission staff, but this is subject to articles 5, 8, 9, and 11. For military, naval, or air attachés, the receiving State may require their names to be submitted in advance for approval.

Diplomatic staff should normally be nationals of the sending State. Appointment of someone with the receiving State’s nationality is only allowed with that State’s consent, which it can withdraw at any time. The receiving State may also keep the same right for qualifying third-State nationals.

The receiving State may declare certain mission staff persona non grata or not acceptable, and the sending State must then recall the person or end their mission functions.

A person may be declared non grata or not acceptable before arriving in the territory of the receiving State. 1. The receiving State’s foreign ministry, or another agreed ministry, must be notified about mission members and certain family members and servants, including appointments, arrivals, departures, and terminations.

The receiving State may limit a mission’s size to reasonable and normal bounds, and may refuse officials of a particular category.

The sending State may not set up mission offices in other localities unless the receiving State has given prior express consent.

This article says when the Convention starts to apply: on the 30th day after the 22nd ratification or accession is deposited, and later ratifying or acceding States are bound 30 days after their own deposit.
