Purpose and legislative effect

“This article defines key terms used in the Convention.”

This article defines key terms used in the Convention. A State may send a special mission to another State if that other State has already consented. The functions of a special mission are set by mutual consent of the sending State and the receiving State. A State sending the same special mission to two or more States must inform each receiving State when seeking consent. Two or more States sending a joint special mission to another State must inform the receiving State when seeking that State’s consent.

Waiver of immunity

Special mission representatives should generally be nationals of the sending State; receiving-State nationals cannot be appointed unless that State consents.

Article 11 requires advance notification of certain special mission changes and movements to the receiving State’s foreign ministry or another agreed organ.

The Secretary-General of the United Nations must notify certain States about Convention signatures, deposits of ratification or accession instruments, and the date the Convention enters into force.
