This article defines key terms used in the Convention, including person, national, operator, installation state, nuclear fuel, nuclear material, nuclear installation, nuclear damage, and nuclear incident. The operator of a nuclear installation is liable for nuclear damage if it is proved to have been caused by a nuclear incident, and generally no one else is liable unless the Convention says otherwise. The operator must keep insurance or other financial security for nuclear damage, and the Installation State sets the amount, type, and terms. The liable operator must give the carrier a certificate about the required financial security, and the issuer may not dispute the stated details. The operator’s liability for nuclear damage is generally absolute, but there are specific exclusions and exceptions.
