About this statute

Ratifying ILO Members must create or keep a system for setting minimum wages in certain trades with low wages and no effective wage-fixing arrangements. A ratifying Member may decide where the minimum wage-fixing machinery applies, after consulting worker and employer organisations if any. Members may choose the minimum-wage machinery, but employers and workers must be consulted and involved, and fixed minimum wage rates are binding unless an authorized exception applies. Members must use supervision and sanctions to inform affected employers and workers about minimum wage rates and prevent payment below those rates. A worker paid less than the applicable minimum rates may recover the underpaid amount through legal proceedings, subject to any time limit set by national law or regulations. Each ratifying Member must send the International Labour Office an annual general statement about minimum wage-fixing application.
