About this statute

The State Party recognizes the Committee’s power to receive and consider communications submitted under Article 2. Communications may be submitted by individuals or groups of individuals, or on their behalf, if they are under a State Party’s jurisdiction and claim to be victims of a violation. Communications must be in writing, must not be anonymous, and the Committee must not receive communications about a State Party that is not party to the Protocol. The Committee may only consider a communication after domestic remedies are exhausted, unless they are too slow or ineffective, and must declare communications inadmissible on several listed grounds. The Committee may ask the concerned State Party to take interim measures to prevent possible irreparable harm to alleged victims, after receiving a communication and before deciding the merits.
