About this statute

This article requires a Contracting State to give nationality to certain stateless people born in its territory, and it restricts when applications may be refused. A foundling found in a Contracting State is presumed to have been born there to parents with that State’s nationality, unless there is proof otherwise. For this Convention, a birth on a ship or aircraft is treated as having taken place in the territory of the relevant flag or registration State. A Contracting State must grant nationality to certain stateless people born outside its territory if a parent had that nationality at birth, and it may set limited conditions for applications. A child who loses nationality because of a recognition of affiliation must be allowed to recover that nationality by written application to the appropriate authority, subject to the stated conditions.
