About this statute

This Order sets out how to test plant varieties for distinctness, uniformity, and stability. When testing a plant variety, the registrar must review the application and supporting documents, check novelty and formal requirements, arrange DUS testing, assess the proposed name, and ensure fees are paid. The registrar must tell the applicant how many seeds or propagating material are needed for the test, and provide the delivery address and deadline. The plant variety registrar may arrange distinctness, uniformity and stability testing, including through its own institution, another approved competent institution or person in Rwanda, institutions or persons in another State, or by relying on results from other States or inter-governmental member organizations. The certificate of grant of plant breeder’s rights is set out in Annex II of the Order.
