Crimes committed are placed into the first, second, and third category. This provision establishes Gacaca Cell, Sector, and Appeal Courts and assigns them jurisdiction over certain genocide and crimes against humanity cases. The General Assembly of a Gacaca Cell Court includes all residents in the court area who are at least 18. If there are fewer than 200 such residents, the area is merged with another cell court in the same sector. The general assemblies of the Gacaca Court at cell and sector level elect seven judges and two substitutes for the bench. A Gacaca court member must be replaced if any listed grounds occur, and dismissal must be decided in writing after consultation with the cell’s General Assembly.
