Parmi ces décaissements figurent les fonds destinés à honorer le service de la dette publique, la restitution du trop-perçu d’impôts et d’autres recettes définis par la loi, les créances décidées par les tribunaux contre l’Etat et les budgets de fonctionnement approuvés des institutions prévues par la Constitution. 10° Fonds consolidé : fonds qui contient toutes les recettes et autres fonds de l’Etat tel que défini à l’article 7 de la présente loi organique. 11° Entités Administratives Décentralisées : tous les organes élus et jouissant des pouvoirs leur dévolus par la loi pour préparer et mettre en œuvre leurs plans d’action en exécution du budget qu’ils ont préparé. Ces organes sont établis et régis par une loi. 12° Ministre : Ministre ayant les finances dans ses attributions. 13° Ministère : Ministère ayant les finances dans ses attributions. 14° Entreprises publiques : personnes morales de droit public créées par l’Etat et appartenant entièrement ou partiellement au Gouvernement central ou aux Entités Administratives Décentralisées pour vendre les biens et services. 15° Autres établissements publics : entités publiques autonomes et semi-autonomes ainsi que les fonds bénéficiant des allocations extrabudgétaires. 16° Fonds publics : toutes les sommes perçues par l’Etat ou par le Ministre ou par un agent de l’Etat ou toute autre personne habilitée y compris les taxes et impôts perçus par les établissements publics compétents, les dons et prêts de l’Etat et toutes les autres sommes qui sont, sur ordre du Ministre, déposées sur les comptes du fonds consolidé, à l’exclusion des fonds reçus ou décaissés par les entreprises publiques dotées de l’autonomie administrative. 17° Agent de l’Etat : toute personne occupant une fonction publique et rémunérée à partir des fonds de l’Etat. 18° Etat : Gouvernement central et Entités Administratives Décentralisées ainsi que toutes les personnes morales dotées de la personnalité telles que les fonds extrabudgétaires et les fonds spéciaux, de même que les institutions qui dépendent des financements du Gouvernement central ou des Entités Administratives Décentralisées. Article 13: In order for the Minister to perform his or her functions as provided for by article 12 of this organic law, he/she shall have the powers of: 1° establishing, following Cabinet approval, units within his or her ministry for implementing the 2° requirements under this organic law; informing in writing, following Cabinet approval, Chief managers responsible for budget management and outlining their roles and responsibilities in financial management; 3° ensuring, in collaboration with other Ministers and the Chief Budget Managers, the establishment of units in budget agencies for the accounting of all budgetary revenues and expenditures; 4° establishing, after consultations with the Ministry in charge of local administrative entities, mechanisms for coordinating the implementation of the relevant provisions of this law that pertain to local administrative entities; issuing instructions relating to appropriate relations with the banks; 5° 6° assign responsibilities and instructions in the Ministry for management of cash resources including cash flow in transparency in all State budget agencies; 7° having unrestricted access to documents and financial management records of state budget agencies and other public bodies; 8° preparing and submitting to the Cabinet meeting the regulations including the finance management 9° procedures for approval; issuing instructions of preparation, use, accounting, control, reporting or monitoring extra budgetary funds and autonomous funds and public entities funds; 10° collecting and gathering names and sample signatures of all authorized officers before the start of the financial year, or whenever an authorized person to pay changes; 11° establishing appropriate internal audit procedures of each entity to enable it fulfill its duties and responsibilities; 12° establishing in the Ministry appropriate and coordinated procedures for revenue and expenditure management in public treasury while carrying out at least the following activities: cash management, financial planning, forecasting of cash flows, management of payment and other treasury operations, public debt management, administration of foreign grants and counterpart funds from international aid, and financial assets management; 13° setting up appropriate ways to manage, monitor and report on public property.
