LAW N° 29/2006 OF 20/07/2006 MODIFYING AND COMPLEMENTING LAW N° 34/2001 OF 05/07/2001 RELATING TO REFUGEES

Ingingo ya mbere: Article One: Article premier : L’article 3 de la loi n° 34/2001 du 05/07/2001 sur les réfugiés est modifié et complété comme suit : «Il est créé un Conseil National pour les Réfugiés. Ce Conseil traite et examine les problèmes des réfugiés étrangers se trouvant au Rwanda et ceux des réfugiés rwandais résidant à l’étranger et se prononce sur ces problèmes.»

Inama y’Igihugu ishinzwe Impunzi ikoresha abakozi bagengwa na sitati rusange igenga abakozi ba Leta n’inzego z’imirimo ya Leta.” Article 3 of law n° 34/2001 of 05/07/2001 relating to refugees is modified and complemented as follows: "There is hereby established a National Refugee Council. The Council follows up and examines issues of foreign refugees who seek asylum in Rwanda and Rwandan refugees in diaspora and thereafter takes decisions." Article 3: The law n° 34/2001 of 05/07/2001 relating to refugees is complemented by articles 8 bis and 8 ter which are as follows: "Article 8 bis : The Executive Secretary of the National Refugee Council has the following responsibilities: 1° to coordinate the activities of the Executive Secretariat of the National Refugee Council; 2° to be the rapporteur of the meetings of the National Refugee Council; 3° to prepare a draft budget and action plan and forward them to the National Refugee Council for approval; 4° to prepare an annual activity report and at any time it is considered necessary and forward it to the National Refugee Council; 5° to be the interlocutor between the National Refugee Council and administrative organs and other partners; 6° to transmit to the National Refugee Council files of Refugee Status applicants for examination and decision making; 7° to notify applicants for Refugee status of the decision taken by the National Refugee Council; 8° to coordinate the activities of mobilising and repatriating Rwandan Refugees in Diaspora, and resettling them in their properties; 9° to coordinate the activities of foreign refugee settlements in Rwanda; 10° to prepare the draft of rules of procedure of the National Refugee Council for consideration before approval by the Minister in charge of refugees; 11° to perform any other activities related to his or her responsibilities as may be requested by the Minister in charge of refugees, the National Refugee Council and any other competent organs." “Article 8 ter: The National Refugee Council uses resources originating from the State Budget, aid, grant or bequest. The National Refugee Council staff is governed by the General Statutes for Rwanda Public Service. " Article 3 : La loi n° 34/2001 du 05/07/2001 sur les réfugiés est complétée par les articles 8 bis et 8 ter libellés comme suit : «Article 8 bis : Le Secrétaire Exécutif du Conseil National pour les Réfugiés a les responsabilités suivantes : 1° coordonner les activités du Secrétariat Exécutif du Conseil National pour les Réfugiés ; 2° être le rapporteur des réunions du Conseil National pour les Réfugiés ; 3° préparer l’avant-projet du budget et le plan d’actions qu’il transmet au Conseil National pour les Réfugiés pour adoption ; 4° élaborer un rapport annuel des activités et chaque fois que de besoin et le transmettre au Conseil National pour les Réfugiés ; 5° être l’interlocuteur entre le Conseil National pour les Réfugiés, les instances administratives et les autres partenaires ; 6° transmettre au Conseil National pour les Réfugiés les dossiers de demandeurs d’asile pour examen et décision; 7° communiquer aux demandeurs d’asile la décision prise par le Conseil National pour les Réfugiés ; 8° coordonner les activités de sensibilisation et de rapatriement des réfugiés rwandais vivant à l’étranger ainsi que la réinstallation dans leurs biens; 9° coordonner les activités des camps de réfugiés étrangers se trouvant au Rwanda; 10° préparer l’avant projet du Règlement d’Ordre Intérieur du Conseil National pour les Réfugiés pour l’examen de ce dernier avant d’être approuvé par le Ministre ayant les réfugiés dans ses attributions ; 11° exécuter toutes les autres tâches rentrant dans ses attributions lui assignées par le Ministre ayant les réfugiés dans ses attributions, le Conseil National pour les Réfugiés ou les autres instances compétentes.» «Article 8 ter : Le Conseil National pour les Réfugiés utilise les ressources qui proviennent du budget de l’Etat, des aides, des dons ou legs. Le personnel du Conseil National pour les Réfugiés est régi par la loi portant statut général de la fonction publique rwandaise.»

Ingingo ya 2 : Article 2: Article 2 : L’article 5 de la loi n° 34/2001 du 05/07/2001 sur les réfugiés est modifié et complété comme suit : «Les attributions du Conseil National pour les Réfugiés sont les suivantes : 1° mettre en application le cadre politique régissant les réfugiés en général ; 2° veiller au respect des droits des réfugiés se trouvant au Rwanda et des rapatriés rwandais ; 3° examiner les dossiers de demande de statut de réfugiés qui veulent s’établir au Rwanda et se prononcer sur ces dossiers ; 4° retirer le statut de réfugié aux réfugiés établis au Rwanda qui ne se conforment pas à la législation relative aux réfugiés en vigueur ; 5° mobiliser toutes les ressources nécessaires pour accomplir l’action de rapatriement des réfugiés rwandais et leur réintégration sociale au Rwanda ; 6° promouvoir et veiller aux bonnes relations de travail entre le Rwanda, le Haut Commissariat des Nations Unies pour les Réfugiés (UNHCR) et les pays dans lesquels les Rwandais se sont réfugiés, afin que leur rapatriement soit effectué sans problèmes ; 7° examiner et approuver le rapport d’activités relatives aux réfugiés et aux rapatriés, élaboré par le Secrétaire Exécutif ; 8° élaborer le budget relatif aux réfugiés installés au Rwanda et les réfugiés rwandais rapatriés; 9° soumettre le rapport d’activités au Ministre ayant les réfugiés et les rapatriés dans ses attributions ; 10° assister le gouvernement dans la coordination des activités des Organismes non Gouvernementaux locaux et des Agences Internationales qui collectent les fonds pour l’action de rapatriement et de réintégration des réfugiés.»

Ingingo ya 5 y’Itegeko n° 34/2001 ryo kuwa 05/07/2001 ryerekeye impunzi ihinduwe kandi yujujwe ku buryo bukurikira: “Inama y’Igihugu ishinzwe Impunzi ifite inshingano zikurikira : 1° gushyira mu bikorwa umurongo wa politiki ugenga impunzi muri rusange; 2° bwubahirizwa mu Rwanda; gukurikirana uko uburenganzira bw’impunzi ziri mu Rwanda n’ubw’Abanyarwanda bahunguka 3° 4° gusuzuma inyandiko z’abasaba ubuhungiro mu Rwanda no kuzifataho ibyemezo; kwambura ubuhungiro impunzi zahungiye mu Rwanda zitubahirije amategeko agenga impunzi; 5° buzima busanzwe mu Rwanda kigerweho; gushakisha ibikenewe byose kugira ngo igikorwa cyo gucyura impunzi z’Abanyarwanda no kuzisubiza mu gushakisha no gukurikirana imikorere iboneye hagati y’u Rwanda, Ishami ry’Umuryango w’Abibumbye 6° ryita ku mpunzi (UNHCR) n’ibihugu impunzi z’Abanyarwanda zahungiyemo kugira ngo ihunguka ryazo ritungane nta nkomyi; 7° n’Umunyamabanga Nshingwabikorwa; gusuzuma no kwemeza raporo y’ibikorwa byerekeranye n’impunzi n’abahunguka, yakozwe 8° 9° gutegura ingengo y’imari yerekeye impunzi ziri mu Rwanda n’Abanyarwanda bahunguka; guha raporo y’ibikorwa Minisitiri ufite impunzi n’abahunguka mu nshingano ze; 10° mpuzamahanga ashakisha inkunga yo gufasha mu gikorwa cyo gucyura no kwakira impunzi.” gufasha Guverinoma mu guhuza ibikorwa by’imiryango ikorera mu Rwanda n’amashyirahamwe Ingingo ya 5 : Article 5 of law n° 34/2001 of 05/07/2001 relating to refugees is modified and complemented as follows: "The National Refugee Council has the following responsibilities: 1° to implement the policy governing refugees in general; 2° to monitor how the rights of refugees living in Rwanda and those of Rwandan returnees are respected in Rwanda; 3° to examine and make decisions on applications of persons seeking refugee status in Rwanda; 4° to retract refugee status from any refugee that does not respect laws on refugees in Rwanda; 5° to mobilize all necessary resources in order for the achievement of repatriation and reintegration activities of Rwandan refugees in Rwanda; 6° to establish and follow up good working relationship between Rwanda, United Nations High Commission for Refugees (UNHCR) and Countries in which Rwandans sought asylum so that their repatriation is effected without hindrance; 7° to examine and approve activity report relating to refugees and returnees prepared by the Executive Secretary; 8° to draft a financial budget relating to refugees living in Rwanda and the Rwandan returnees; 9° to submit an activity report to the Minister in charge of refugees and returnees; 10° to assist the Government in co-ordinating the activities of Local Associations and International Organisations operating in Rwanda which mobilise funds to assist in repatriation and reintegration of refugees." Article 5: Article 5 : L’article 18 de la loi n° 34/2001 du 05/07/2001 sur les réfugiés est modifié et complété comme suit : «La Haute Cour de la République se prononce dans un délai ne dépassant pas trente (30) jours qui suivent la clôture des débats.»

Ingingo ya 4 : Article 4: Article 4 : L’article 17 de la loi n° 34/2001 du 05/07/2001 sur les réfugiés est modifié et complété comme suit : «Lorsque le demandeur du statut de réfugié se sent lésé par la décision du Conseil National pour les Réfugiés, il peut, endéans quinze (15) jours ouvrables suivant la notification du refus, saisir la Haute Cour de la République. Le demandeur a droit de demeurer au Rwanda jusqu’au jour où la Cour aura rendu public le jugement irrévocablement.»

Ingingo ya 17 y’Itegeko n° 34/2001 ryo kuwa 05/07/2001 ryerekeye impunzi ihinduwe kandi yujujwe ku buryo bukurikira : “Iyo uwasabye kwemererwa ubuhunzi atanyuzwe n’icyemezo cy’Inama y’Igihugu ishinzwe Impunzi, ashobora kuregera Urukiko Rukuru rwa Repubulika mu gihe kitarenze iminsi cumi n’itanu (15) y’akazi uhereye umunsi yamenyesherejweho icyo cyemezo. Mu gihe yatanze ikirego, usaba kwemererwa ubuhunzi akomeza kugira uburenganzira bwo kuba mu Rwanda kugeza umunsi urukiko ruciye urubanza ku buryo budasubirwaho.” Article 17 of law n°34/2001 of 05/07/2001 relating to refugees is modified and complemented as follows: "If a person applying for refugee status is not satisfied with the decision taken by the National Refugee Council, he or she may file a case to the High Court of the Republic within a period not exceeding fifteen (15) working days starting from the day he or she was notified of the decision. The applicant for refugee status shall have the right to stay in Rwanda during the period in which he or she filed the case, until the day the Court seized renders its irrevocable decision.”

Ingingo ya 18 y’ itegeko n° 34/2001 ryo kuwa 05/07/2001 ryerekeye impunzi ihinduwe kandi yujujwe ku buryo bukurikira : “Urukiko Rukuru rwa Repubulika rufata icyemezo mu minsi itarenze mirongo itatu (30), kuva iburanisha rirangiye.” Article 18 of law n° 34/2001 of 05/07/2001 relating to refugees is modified and complemented as follows: "The High Court of the Republic renders a decision in a period not exceeding thirty (30) days from when the hearing is concluded."

Ingingo ya 6: Article 6: Article 6 : L’article 19 de la loi n° 34/2001 du 05/07/2001 sur les réfugiés est modifié et complété comme suit : «Le Conseil National pour les Réfugiés met en exécution la décision judiciaire irrévocable.»

Ingingo ya 19 y’ itegeko n° 34/2001 ryo kuwa 05/07/2001 ryerekeye impunzi ihinduwe kandi yujujwe ku buryo bukurikira : “Inama y’Igihugu ishinzwe Impunzi ishyira mu bikorwa icyemezo cy’Urukiko rwaciye urubanza ku buryo budasubirwaho.” Article 19 of law n° 34/2001 of 05/07/2001 relating to refugees is modified and complemented as follows: "The National Refugee Council shall implement an irrevocable judicial decision.”

Ingingo ya 7 : Ingingo zose z’amategeko abanziriza iri kandi zinyuranye na ryo zivanyweho. Article 7: All previous legal provisions contrary to his law are hereby repealed. Article 7 : Toutes les dispositions légales antérieures contraires à la présente loi sont abrogées.
