Ingingo ya 3: Gusaka Article 3: Search Article 3: Perquisition Ingingo ya 3: Gusaka Article 3: Searching Article 3 : Perquisition Les Officiers compétents mentionnés à l‟article 2, peuvent entrer dans n‟importe quel endroit où l‟on suspecte des activités nuisibles à l‟environnement et Y effectuer des perquisitions. Lorsque les Officiers se rendent comptent qu‟ils risquent de subir des agressions de la part des gens qui font l‟objet de perquisition, ils font recours à l‟assistance de la Station de police ou des autorités de base les plus proches. Les Officiers compétents peuvent également mener des inspections auprès des entreprises ou activités en vue de s‟assurer que l‟environnement est bien conservé et protégé, quand bien même ledit endroit ne serait pas suspecté. Toute inspection de routine s‟effectue en présence de la personne concernée ou son délégué, qui doit être avisée quarante huit (48) heures avant. The competent officers mentioned in Article 2, may enter and carry out a search in any place suspected to be carrying out activities which pollute the environment. When the Officers figure out that they might be harmed by the person under search, the nearest police station or local authority shall be called upon to assist in the process. In case of routine inspection, the person to be inspected shall be informed forty eight (48) hours prior to the inspection and it is carried out in his/her presence or in the presence of a person he/she has delegated. 65 JO N°22 OF 15/11/2008

Competent officers may temporarily seize products which excessively pollute the environment pending a final decision. During the inspection, the competent officer may take samples of suspected products for examination in appropriate laboratories for the purpose of making sure that their components are not harmful to the environment Article 5 : Analyse des échantillons des produits suspectés Au cours de l‟inspection, l‟officier compétent peut prélever des échantillons des produits suspectés afin de les faire analyser dans un laboratoire pour déterminer s‟ils contiennent des composants susceptibles de nuire à l‟environnement.

During routine inspection there needs to be a standard checklist of what needs to be verified and it should be signed by both the competent officer and the owner of the company or activity after the inspection. The contesting party may request another inspection to be carried out by an independent and competent environmental expert. Les frais de l‟expertise indépendante sont à charge de la personne qui conteste les conclusions du rapport d‟inspection de REMA.

When necessary the expert may request for an additional period.
