UMUTWE WA III : AMAHAME REMEZO Article 4 : In this Organic law: Environment is a diversity of things made up of natural and artificial environment. It includes chemical substances, biodiversity as well as socio-economic activities, cultural, aesthetic, and scientific factors likely to have direct or indirect, immediate or long term effects on the development of an area, biodiversity and on human activities. A. The natural environment The natural environment is composed of soil and subsoil, water, air, biodiversity, mountains and landscapes, tourist sites and monuments. 1° Soil is the surface land that hosts living things like plants, animals and people, any type of buildings as well as all things that exist underground. Underground means beneath the soil. 2° Water is one of the natural resources of the earth. As it forms, some will be trapped making pools of water, flowing and underground water. Depending on where it is and how it forms, it may change its name in the following manner: stagnant water is that of the oceans, lakes, ponds, pools and swamps; flowing rain water; flowing river and stream water; a. b. c. d. water that penetrates the soil; e. underground water. 3° Air is a mixture of gaseous fluid in the atmosphere and which is breathed by biodiversity but which can create effects on their existence and the environment in general. In gases, we find air that we breath or natural gas like methane gas; 4° Biodiversity is the variability of the living organisms of all types including man, animals of all species, plants of all types, be it on land or underground, in water as well as in the atmosphere and the interactions among them. A biotope is a geographical area where all the environment’s physical and chemical factors remain more or less constant; c. Ecology is a study of the different kinds of environment where biodiversity live, reproduce and die, as well as the relationship among them. 5° Landscape is a general outlook of an area made of mountains, forests, plainlands, valleys, swamps, lakes, rivers and streams. a. a mountain is an elevated part of the earth higher than the plainlands and swamps; b. plain land is a flat area with little water and less biodiversity; c. a valley is an area between two mountains characterised by a source of water above the ground or underground; d. a swamp is a flat area between mountains with much stagnant water and biodiversity, with papyrus,cypress or other vegetation of the same family; e. a wetland is a place made up of valleys, plainlands and swamps. 6° Site is a place selected because of its natural beauty or its special history. 7° Natural monument is a place characterised by natural elements. B. Human environment: Human environment is the organisation of an area relating to his or her social welfare. It is made up of those that are destructive and those that are not. B.1. Those that are destructive: It is made up of pollutants, waste, hazardous waste, installations and pollution. 1° pollutants are any waste disposal whether solid, liquid or gaseous, all wastes, smell, heat, excessive automobile noise, unbearable music noise, echo, radiation or combination of all that are likely to be destructive. 2° Waste is any substance whether solid, liquid or gaseous resulting from household activities, from manufacturing plants or any abandoned movable or immovable property, and which may be harmful. 3° Hazardous wastes are any substances whether solid, liquid or gaseous that cause a serious harm to human health, security and other biodiversity together with the quality of the environment. 4° Installation is any building that is fixed to a certain place or its replacement may cause disruption of the environment regardless of the owner and its value. 5° Pollution is the contamination caused by waste, harmful biochemical products derived from human activities that may alter man’s habitat and cause adverse effects on the environment like man's social well being, animals, flora and fauna and the world he or she lives in. Pollution may be: a. Marine pollution which is caused by contamination of water by any substance that may change its physical, chemical or biological characteristics which may cause disease to human and animals that use it, aquatic life, plants or which may change the beauty of tourist sites, adjacent valleys and swamps; b. Atmospheric pollution is a voluntary or accidental contamination of the atmosphere and the surrounding air, gas, smoke, any particles or substances that may endanger biodiversity, human health and their security or disrupt agricultural activities, disrupt installations or the nature of tourist sites and mountains; c. Transboundary pollution is the contamination originating from one country to another. B. 2. Those that are not destructive: Activities that are aimed at enriching and reducing the adverse effects on the environment like afforestation, preparing entertainment places and applying technology geared at reducing human effects on environment. C. Other terms used 1° Sustainable development is an effective method of using the environment with an aim of exploiting it to support the present and plan for future generations in consideration of conserving biodiversity, play a role in what constitutes biodiversity and equal distribution of benefits derived from their use and the technology applied on them. 2 ° Environment impact assessment is an evaluation which identifies effects that may be caused by planned human activities or a project. 3° Evaluation on the environment is a procedure of assessing and controlling the activities of conserving the environment. 4° The Environment Impact Assessment Bureau is a service instituted by competent authority with the responsibility of following up the environment impact assessment. 5° The Competent authority is a service or several services with competence provided for by law. CHAPTER III : FUNDAMENTAL PRINCIPLES Article 4 : Aux termes de la présente loi organique: L’environnement est l’ensemble des éléments composés de l’environnement naturel et de l’environnement humain. On y trouve les éléments chimiques, la diversité biologique ainsi que des facteurs socio-économiques, culturels, esthétiques, scientifiques susceptibles d’avoir un effet direct ou indirect, immédiat ou à terme, sur le développement du milieu, des êtres vivants et des activités humaines. A. L’environnement naturel: L’environnement naturel est composé du sol et du sous-sol, l’eau, l’air, la diversité biologique, des paysages, des sites et des monuments naturels. 1° Le sol est une superficie constituant le support des êtres vivants comme les végétaux, les animaux, les hommes et toute sorte de construction ainsi que toute la matière du sous-sol. Le sous-sol est la partie profonde d’un sol. 2° L’eau est une des composantes des ressources naturelles de la Terre. Selon leur situation, on distingue les eaux stagnantes, les mares, les eaux courantes et les eaux souterraines. Suivant leur position et leur mouvement au cours du cycle, elles changent d’appellation comme suit : a. Les eaux stagnantes sont celles des mers et océans, des lacs, des mares, des étangs et des marécages ; b. Les eaux de ruissellement de la pluie; c. Les eaux courantes des fleuves, rivières et ruisseaux ; d. Les eaux d’infiltration; e. Les eaux souterraines. 3° L’air est le fluide gazeux de la couche atmosphérique terrestre respirable par la biodiversité, mais qui peut porter atteinte à la santé des êtres vivants, aux écosystèmes et à l’environnement en général. On trouve dans le gaz l’air respirable ou l’air naturel comme le gaz méthane. 4° La diversité biologique est la variabilité des organismes vivants de toute origine, y compris, entre autres, l’homme, les animaux de toutes sortes, les écosystèmes de toutes sortes qu’ils soient terrestres, souterrains, marins et autres écosystèmes aquatiques et les complexes écologiques dont ils font partie. Les organismes sont tous ceux qui respirent. a. L’écosystème est une partie spécifique terrestre ou aquatique où on trouve la diversité biologique qui forme un complexe dynamique ; b. Un biotope est l’aire géographique où l’ensemble des facteurs physiques et chimiques de l’environnement reste sensiblement constant ; c. L’écologie est l’étude des milieux où vivent, se reproduisent et meurent les êtres vivants ainsi que des rapports de ces êtres vivants entre eux. 5° Le paysage est constitué d’un ensemble d’une portion du territoire composée par les montagnes, les forêts, les plaines, les vallées, les marais, les lacs, les rivières et les ruisseaux. a. Une montagne est une partie saillante de l’écorce terrestre à la fois élevée, plus haute que les plaines et les marais ; b. Une plaine est une surface continentale étendue, plane et peu élevée caractérisée par peu de marécages et une pauvreté en biodiversité ; c. Une vallée est une dépression allongée entre deux montagnes, généralement parcourue par un cours d’eau ou renfermant des eaux souterraines ; d. Un marais (ou marécage) est une région basse étendue entre les montagnes où sont accumulées les eaux stagnantes et la biodiversité, où poussent le papyrus, la cyperus et autres végétaux de la même famille. e. Une zone humide est un milieu territorial formé des vallées, des plaines et des marécages. 6° Le site est une portion de paysage choisie, particularisée par ses caractéristiques géographiques et /ou son histoire. 7° Le monument naturel est un élément ou un groupe d’éléments naturels et non façonné par l’homme. B. L’environnement humain L’environnement humain concerne les activités humaines et l’aménagement du territoire relatif à son cadre de vie. Il comprend les éléments nuisibles et les éléments non nuisibles. B.1. Les éléments nuisibles : Les éléments nuisibles sont composés des polluants, des déchets, des déchets dangereux, installation et pollution. 1° Les polluants sont tous rejets solides, liquides ou gazeux, tous déchets, odeur, chaleur, des sons extrêmes des véhicules, des musiques faisant mal aux oreilles, vibrations, rayonnement ou combinaison de ceux-ci susceptibles de provoquer une pollution. 2° Les déchets sont des produits solides, liquides ou gazeux résultant des activités des ménages, d’un processus de fabrication ou tout bien meuble ou immeuble abandonné et qui peut ruiner. 3° Les déchets dangereux sont des produits solides, liquides ou gazeux, qui présentent une menace sérieuse ou des risques particuliers, pour la santé humaine, la sécurité et sur des autres êtres vivants et la qualité de l’environnement. 4° Installation est tout dispositif ou toute unité fixe ou mobile susceptible d’être générative d’atteinte à l’environnement, sans considération de son propriétaire et sa valeur. 5° La pollution est la contamination due aux déchets, les substances chimiques dangereux dus à l’action de l’homme susceptible d’altérer le milieu de vie de l’homme et d’avoir un impact négatif à l’environnement comme à la santé, à la sécurité, au bien-être de l’homme, de la flore et de la faune et sur la terre où il habite. La pollution peut être : a. La pollution des eaux est la contamination causée par l’introduction dans le milieu aquatique de toute substance susceptible de modifier les caractéristiques physiques, chimiques et/ou biologiques de l’eau et de créer des risques pour la santé de l’homme, de nuire à la faune et à la flore terrestre et aquatique, de porter atteinte à l’agrément des sites, des vallées et des marécages qui les entourent. b. La pollution atmosphérique ou pollution de l’air est l’émission volontaire ou accidentelle dans la couche atmosphérique de gaz, de fumée, de particules ou de substances de nature à créer des nuisances pour les êtres vivants, à compromettre la santé ou la sécurité publique ou à nuire à la production agricole, à la conservation des édifices ou au caractère des sites et paysages. c. La pollution transfrontière est la pollution qui a son origine dans un pays et dont les effets se propagent dans un autre pays. B.2. Les éléments non nuisibles : Les activités de nature à sauvegarder et atténuer les impacts négatifs sur l’environnement à l’instar du reboisement, l’aménagement des endroits de détente et le recours à la technologie visant à amoindrir les conséquences négatives des activités humaines sur l’environnement. C.
