Statute overview

About this statute

A human corpse may not be cremated without authorization from the civil registrar, or if unavailable, the administrative authority. The funeral authorization application must be submitted by the person authorized to handle the funeral, state the proposed conditions, and include a medical certificate showing no signs of violent death. If cremation authorization is refused, a burial permit is issued automatically; the applicant may appeal to the District Commissioner. If the District Commissioner’s decision is still unknown within 48 hours after death, the body must be buried immediately. If there are signs of violent death, a cremation permit may be issued only after an autopsy and with the matching opinion of the public prosecutor, or, if unavailable, the judicial police officer with general competence. The civil status officer may always appoint a doctor of their choice to check the medical certificate and verify whether there are signs of violent death.
