About this statute

This Order sets the list of works, activities, and projects that need environmental and social impact assessment before they may be authorised, and it sets the procedures for carrying out that assessment. This article defines key terms used in the Order, including the Authority, authorised organ, developer, environmental and social impact assessment, practitioner, practitioners firm, public hearing, selected practitioner, and stakeholder consultation. Article 3 says works, activities, and projects listed in Annex 1 need a full environmental and social impact assessment, those in Annex 2 need a partial assessment, and the Authority or authorised organ may require a full assessment for Annex 2 projects suspected of causing negative and irreversible impacts. Developers may not carry out Annex 1 or 2 works, activities, or projects without an environmental and social impact assessment approval certificate, and State organs may not issue approvals without proof of that certificate. Works, activities and projects not listed in Annex 1 or 2 are exempt from environmental and social impact assessment, unless the Authority or authorised organ requests one in the conditions described.
