Statute overview

About this statute

Employers must pay required pension fund contributions in full, send supporting information on time, and late payments or late transfers attract interest. A transferring fund must move eligible benefits or rights to another fund within 60 days of a written request, unless a longer period is set. This amendment limits how much of a registered fund’s assets may be invested or lent to an employer’s business, with a default cap of 5% and a possible increase to 10% by the registrar. This section changes the rules for terminating or dissolving a registered fund, including liquidation steps, inspection of accounts, objections, exemptions, and final cancellation or confirmation by the registrar. The registrar may set, adjust, or refuse liquidator remuneration for a voluntarily terminated or dissolved fund, and must do so by notice in the Gazette for the services covered and the tariff. Section 19 of the Financial Institutions Amendment Act, 1992 is repealed, and this Act starts on a date set by the President by proclamation in the Gazette.
