About this statute

This section replaces section 6 of the Maintenance Act to further regulate complaints about maintenance. This section replaces section 6 and requires a maintenance officer to investigate certain complaints lodged in the prescribed manner. A maintenance officer may seek a court direction for contact information, and an electronic communications service provider must furnish that information if the court issues the direction. A maintenance officer may ask the maintenance court for a warrant when a complaint has been filed and the person cannot be found; the court can order electronic communications providers to give the person’s prescribed contact details, and the provider can ask for more time or for the warrant to be withdrawn. A maintenance officer who has started an enquiry in a maintenance court may subpoena a person to appear and give evidence or produce books, documents, or statements.
