Purpose and legislative effect
“This section amends the definitions in section 1 of the principal Act and changes the meaning of several terms.”
This section amends the definitions in section 1 of the principal Act and changes the meaning of several terms. The Commission must make a recommendation or give advice within 180 days of receiving the notification and request, unless another period is agreed. An organ of state that assigns a power or function must explain in a memorandum how it considered the Commission’s recommendation or advice. This provision amends section 1 by changing and adding several definitions. The amendment changes how the Commission gives recommendations on proposed transfers of powers or functions, sets a 180-day deadline, and requires a memorandum explaining how the recommendation was considered. The Commission is given responsibility for its strategic direction and operational policy, and it may do what is necessary or expedient to perform its functions effectively.
