Mineral and Energy Laws Amendment Act

1. In this Act, unless the context otherwise indicates- (i) "national territory" means the area referred to in section 1(2) of the Constitution; (i) (ii) "remainder of the national territory" means the areas which comprised the former Republics of Transkei, Bophuthatswana, Venda and Ciskei and the areas which comprised the territories declared under section 26 of the Self-governing Territories Constitution Act, 1971 (Act No. 21 of 1971), to be self-governing territories; (iii) (iii) "Republic" means the national territory excluding the remainder of the national territory. (ii) Extension of application of certain laws in remainder of national territory 2. (1) The laws mentioned in Schedule 1, as they were in force in the Republic immediately prior to the commencement of this Act, shall, from a date fixed by the President by proclamation in the Gazette, also apply in the remainder of the national territory. (2) Different dates may be fixed in terms of subsection (1) in respect of different laws mentioned in Schedule 1 and in respect of different areas which form part of the remainder of the national territory. (3) Notwithstanding the provisions of subsections (1) and (2), the Minerals Act, 1991 (Act No. 50 of 1991), shall be deemed to have been applicable in the area of the former self-governing territory of KwaNdebele from 19 February 1992. Repeal of laws, and savings 3. (1) Subject to the provisions of this section, the laws mentioned in the second column of Schedule 2 are, from a date fixed by the President by proclamation in the Gazette, repealed to the extent that such laws were in force in the various areas of the remainder of the national territory as set out in the fourth column of Schedule 2, immediately prior to the commencement of the Constitution. (2) Different dates may be fixed in terms of subsection (1) in respect of different laws mentioned in the second column of Schedule 2 and in respect of different areas which form part of the remainder of the national territory. (3) Notwithstanding the provisions of subsections (1) and (2), the Minerals Amendment Act, 1992 (KwaNdebele) (Act No. 8 of 1992), shall be deemed to have been repealed in the area of the former self-governing territory of KwaNdebele from 19 February 1992. (4) Any application for any mining lease made in accordance with any law repealed in terms of subsection (1) and which has been recommended by any mining leases board established in terms of such law prior to the date of the repeal of such law, shall be dealt with as if this Act had not been passed. (5) Anything done under a law repeated in terms of subsection (1) which is capable of being done under a provision of a law mentioned in the second column of Schedule 1, shall be deemed to have been done under such provision of such law. (6) In the application of the transitional provisions of Chapter VII of the Minerals Act, 1991 (Act No. 50 of 1991), in any area of the remainder of the national territory- (a) any reference in the transitional provisions to a provision of a law which was in force in the Republic shall be construed as a reference to a corresponding provision of a law of the relevant area of the remainder of the national territory repealed in terms of subsection (1); and (b) any reference to the commencement of the Minerals Act, 1991, whether expressly or by implication, in the transitional provisions shall be construed as a reference to the date upon which the Minerals Act, 1991, is made applicable in the relevant area of the remainder of the national territory under section 2. (7) Any reference in the Minerals Act, 1991, to the State shall, for the purposes of the application thereof, be construed as a reference to both the national government and any provincial government, without making any distinction.
