The section replaces the definition of “care-dependent child” with a definition covering a child aged 1 to 18 who needs and receives permanent home care because of a severe mental or physical disability. Section 2 amends the principal Act so the Minister must make the grant, subject to the Act and with the concurrence of the Minister of Finance. The Minister may not make regulations under subsection (1) unless the Minister of Finance concurs, except for the listed paragraphs. This section gives the Act its short title and says section 5 starts when the principal Act starts.

Section 1 of the Social Assistance Act, 1992 (hereinafter referred to as the principal Act), is hereby amended by the substitution for the definition of "care-dependent child" of the following definition: " 'care-dependent child' means a child between the ages of one and eighteen years who requires and receives permanent home care due to his or her severe mental or physical disability;". 10 Amendment of section 2 of Act 59 of 1992, as amended by section 15 of Act 118 of 1993 and section 3 of Act 180 of 1993

Section 2 amends the principal Act so the Minister must make the grant, subject to the Act and with the concurrence of the Minister of Finance.

2. Section 2 of the principal Act is hereby amended- ( a) by the substitution for the words preceding paragraph (a) of the 15 following words: · "2. The Minister [may] shall, subject to the provisions of this Act and with the concurrence of the Minister of [State Expendi ture] Finance, out of moneys appropriated by Parliament for that purpose, make-"; and 20 (b) by the substitution for paragraph (g) of the following paragraph: "(g) a care-dependency grant to a parent or foster parent in respect of a care-dependent child.". · Amendment of section 19 of Act 59 of 1992
