About this statute

This section amends the Divorce Act, 1979 by adding a definition of “Muslim marriage.” A court may dissolve a marriage, including a Muslim marriage, by decree of divorce, and such a decree may be granted only on the stated grounds. This section amends section 6 of the principal Act by replacing paragraph (a) in subsection (1) with a new rule about the court being satisfied that arrangements for a minor or dependent child are satisfactory or the best possible in the circumstances. This provision amends the Divorce Act by inserting a definition of “Moslem-huwelik” as teachings of Islam. This provision changes the wording of Article 3 of the Main Act so that a marriage, including a Muslim marriage, may be ended by a court divorce order, on the only grounds stated in the new wording.
