Statute overview

About this statute

This section amends several definitions in the Act and requires administrative processes or decisions under the Act to follow the Promotion of Administrative Justice Act unless the Act provides otherwise. This section sets rules for environmental authorisations, including when activities need authorisation, what applicants must do before applying, and what the Minister or an MEC may regulate. The Minister, or an MEC with the Minister’s concurrence, must identify the competent authority for environmental authorisations when activities are listed or specified under section 24(2). The Minister or MEC concerned must publish a Gazette notice listing the relevant activities or areas and competent authorities, and the notice must state when the list takes effect. No person may start certain listed activities without environmental authorisation, and some activities must be carried out under an applicable norm or standard.
